****** ****** does not abide by her contractual obligations. She's an accountant but her business lacks proper accounting processes. Small Business Resources (SBR) provides accounting and consulting for clients, and it acts as a hub for independent consultants to work with one another on various projects through the contract system that ****** has set up. Contractors sign up with ****** and SBR, and ****** places the consultants on projects that need a consultant and ****** takes a $10 per hour fee for every hour that the consultant works on one of her projects. She invoices the client because she pays her consultants. I had this arrangement with her and SBR and I find her to be unprofessional, slightly incompetent, and borderline criminal.
****** is an accountant but lacks proper accounting practices and record keeping. She sends vital information through first class standard mail, without any traceability and blames the postal service for any mail that you are supposed to receive. I've gone through this twice with her sending me sizable checks. One was lost and now I'm suing her for the principle and damages associated. She did not cancel the check and resend a replacement by Priority or Certified mail, but instead allowed a few weeks to pass *** claims that the check was cashed by an unknown party, but I think she really pocketed the cash. This is for nearly $2,000.
Every payment that I received through her was late, per her own contract's stated payment periods. Days and weeks late, at times. She has also miscalculated the amount of compensation for a large period of time owed from a project.
I am no longer affiliated with her and will be seeing her in court to collect what she owes and potentially seek criminal prosecution if applicable.
I am seeking 111.75 hours totaling $1,872 from ****** ****** and Small Business Resources, plus damages.
Business' Initial Response
******* ****** did not abide by the contract agreement between Small Business Resources and himself as the companys consultant. He was required by contract to provide a writeen 14days notice of terminating agreement. He violated the conflict of interest section of the contract by taking a position with my client company without proper notification as he was requried by contract. **** was paid as a 1099 contractor and did receive his last hours worked. Though the pay schedule was set for every other week, as a small business and as a contractor, there were slight delays but were paid. **** has threatened small claims court and at that time, I will ahear his complaint, as well as addressing mine as Owner and President of Small Business Resources.
Consumer's Final Response
(The consumer indicated he/she DID NOT accept the response from the business.)
****** ******'s response is non factual. She has not paid me for 58.5 hours of work (correction from original response of 111.5) meaning that she still owes me a substantial amount of money for unpaid hours, and has admitted to such in a series of emails between she and I. Her "delays" are understated above as all of her payments to me were late, sometimes extremely so per our agreement. And one was grossly underpaid by 22 hours and she took another week to rectify this after I promptly pointed out her error- showing that she potentially has serious cash flow issues and can be a potential danger if relied upon to manage or oversee cash accounts.
She also doesn't understand her own contract as the written termination between she and I was superseded by her contract with the company- that I am employed by- thus canceling her contract, which in turn canceled my contract with her because the contract was a project-based contract that terminates when the project ends. Which it did, on May 16th. She did not understand that, and did not understand at least another 2 clauses in her contract, in which I had to point out to her and her violation of them. She breached the contracted terms that she herself wrote- meaning, she used a template contract that she didn't read, and as an accountant that is incompetence.
Now I have a Small Claims suit filed against her to reclaim my unpaid hours, in which I have solid documentation and acknowledgement from her. When the judgement is rendered, it will be on her credit report. If anyone does business with ******, perform a background search and the judgment will show in just a few months.
Business' Final Response
It's obvious that this matter will NOT be resolved playing tag with BBB responses. This matter will have to be resolved outside of BBB response system. Thank you.
