Complaint: D&S provided the required escrow inspection service for the property I bought. After moving in, I discovered a small section of dryrot and asked for them to come to reinspect the area within the prescribed 120 day period - which they did. **** (D&S inspector) confirmed that dryrot exists on his second visit, but after repeatedly calling them to determine what they were going to do, they said that under California law that they are not obligated to inspect or correct anything higher than 12 ft above ground, and the damage was well above that (it is true that the damage is on a 2nd story eve - hello - every 2 story building has eves that should be inspected - and all would be above 12 feet). In the two visits that D&S performed, in both cases **** said that "D&S is customer oriented, and would do what is right, and that he would be calling with the the way forward once he had a chance to review the information with the owner." In both cases, I never heard from ****, and didn't hear from **** the owner either until my real estate agent hounded her (she called to have **** come to reinspect a second time).The lack of backing their inspection seems both abnormal and unprofessional to me. Their lack of response tells me that they know they are wrong.I also find it odd that CA escrow inspections on a multi-story building are limited to the 1st story - termite and other damage are often at the eves and facia board - and not just at 12 foot above ground level (I know this is a different matter, but is the foundation of their denial to correct).

Desired Settlement: I would like the dryrot area that they missed on their escrow inspection repaired. The area is clearly visible from the bedroom window, and should have been physically inspected after seeing that there was damage & staining.Their "story" and excuses have been evolving.

Our inspector **** ******** did perform and escrow inspection of the property October 15,
2011. Our inspections are limited to visible and accessible areas as well as under the height
of twelve feet. Please review page two of our wood destroying pests and organisms
inspection report, first and last paragraphs.
 
At the request of the client **** did return to the property to inspect the area that was
visible through a second story window unable to probe the area he suspected that the area
was either stained or infected with fungus. **** retuned to the property with the
understanding the client had to remove the screen to make the area accessible to probe.
**** did probe the area and came to the conclusion that the area is infected with fungus.
 
We clearly do not believe we are responsible. We will however contact the client and make
the repairs as requested.

Thanks for your response, but unfortunately this and other email from you was stuck in my junk email folder and I just noticed them.

 

This issue has not been resolved.  I did get a call from **** @ D&S where she offered to send someone out, but because of her “final answer” and knowing that dryrot does not improve with time, I had already contracted the job.  I did suggest that since the job was completed that she could share in the cost of the repair which I’m certain is less than what her contractor would charge.

 

I’m still waiting on her to respond.
