Complaint: In process of selling our house the termite inspection br (TURBO co.) completed on December 5th, 2013 resulted in the house needing to be fumigated. Our house agents Mr. and Mrs. ***** set up the fumigation to be completed by (TURBO termite and repair) company #************. Where upon Mrs. ****** did sign the Occupant’s, Fumigation Notice form. December 16, 2013: ****** ****** arrived at the residency at 8:30am and noticed the car gate was wide open and the Fumigation tent was still on the house. ****** sat in his car on the side of the road in front of the house for approximately 20 minutes before the fumigation company personnel arrived to remove the fumigation tent. There were 4 personnel. The one who seemed to be in charge was a Mr. ******** **** who is was the one with the house keys at the time. ****** stayed in his car while the personnel climbed on top of the house and removed the tent which took about 40 minutes. Once the tent was totally down some of the personnel entered the house to remove the fumigation fans inside and possibly checking to make sure the house is safe to enter. After Mr. **** deemed that the place was safe to enter he went to Mr. ****** and brought Mr. ****** to the front door where Mr. **** told ****** about how there was a tear in the fumigation tent near the front door. Then showed Mr. ****** that the window in the front had a L shape tear in it. (Mr. ****** did not see the fumigation tent to see if it actually had a tear in it or not before the company had rolled up the tent and took it away. Then Mr. **** briefly showed Mr. ****** that the front door tamper seal key was still in contact that it was not broke. (The tamper seal was a metal key with a strap attached to it that Mr. **** said he attached the strap to the metal bar which was part of the door; Mr. ****** does not understand how the tamper seal works because it should be attached to something inside so that if the door opens the seal breaks but Mr. **** said that the seal was not broke because the robber was already inside the house and just unlocked the door from the inside and left without hafting to break the tamper seal). Mr. **** said to Mr. ****** “it is safe to enter the house” gave the house keys to Mr. ****** then escorted Mr. ****** inside the house to view what happened. The master bedroom had a drawers pulled out on the ground along with 1 broken cabinet drawer handle on the ground, lots of stuff from shelves on the ground and multiple stuff missing from the room listed on the list below. The 2nd bedroom had multiple items missing listed on the list below. The 3rd bedroom had baby clothes pulled out onto the floor and thrown on the bed along with the 3 guitars and guitar cases missing from the closet. At this time Mr. ****** called the National City Police. The other 3 fumigation personnel had already left in the big truck with the tent and only Mr. **** had remained at this time during the police call. After Mr. ****** got off the phone with the police which they had sent an officer to be in route to the house Mr. ****** told Mr. **** that he should stay incase the police have questions for him. Mr. **** responded with that he must catch up with his co-workers to continue other work for the day and Mr. **** left at that time before the police arrived. The Police officer C. ****** ***, arrived at the residency, put on elastic gloves, took pictures of the house: bathroom where the apparent point of entry was and bedrooms. Then the officer took notes on his notepad and called the police office to get the case # *******. Then the police officer left. Comments: Mr. ****** took lots of pictures of all the rooms and bathroom. Friday while the ******s were leaving they had specifically told Mr. **** to close the vehicle gate but when Mr. ****** had arrived on Monday it was wide open. The inside of the house on Monday after the fumigation when Mr. ****** entered all the windows of the house were totally shut and locked which included 7 windows except for 2 windows were left open, 1 being the ripped window. The bathroom where the robber supposedly broke in the window: The window is about 6 feet off the ground and the robber almost definitely would have gone in head first into the house, then to lower himself down he would have had to grab onto the top of the convenient bathroom door or shower door which is the only things there to lower himself down without falling. Both doors still had layers of solid dust on top with no handprints at all. Along with the window seal on the inside still had lots of dust that did not seem to be disturbed which would have been by a persons body scraping along it to fit inside the window. The Occupant’s Fumigation Notice note 12. Reads: (Owner/occupant/agent may post a guard at the property at his/her own discretion and cost. WE WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE DUE TO VANDALISM, THEFT OR OTHER ACTS OF THIRD PARTIES); The ******’s have not read any other specifications of what the Termite employees are supposed to do and what they are not supposed to do in regards to opening and closing and locking the doors and windows during and after the fumigation. If the termite employee had closed and locked all the windows and doors properly then it may have deterred the robber and not made it easy for the thief to only have to enter through a convenient window screen, they would have had to break the window glass as well. The ******’s may just as well had handed the keys to their home directly to a robber. The ******’s strongly believe that the Fumigation company is at fault due to negligence in that they did not properly secure the house after they put the fumigation tent up. After the company places the tent up they are the only ones allowed in the house with all the keys until they deem it safe to enter. December 17, 2013 Mrs. ****** called the TURBO office and talked to the female secretary asking a favor if someone can come back and check the sealed bag foods to make sure the food is fine since no one told Mr. ****** that the food left in the sealed bags were safe to eat or not and Mr. ****** never saw any of the Termite personnel inspect the house with a gas analyzer checking the house which Mr. Jose ****** (who is the TURBO inspector also the one who subcontracted the fumigation job to Mr. ****) said that “By Friday they will put the tent up, close all the windows and doors, put linings of the gas in and start using the medicine inside the house and nobody is allowed inside the house for two to three days and supposed to be by Sunday but the workers do not work on the weekend so they will remove the tent on Monday December 16th and open the windows and doors and check the entire house with a gas detector to make sure no gas is still in any corners of the house”. The secretary told Mrs. ****** on the phone that “there is nothing to worry because of the white paper in front of the door that states that all is safe”. She also said that “two days after they put the medicine they came by and checked the house and opened the doors and windows to make sure the gas will get out of the house”. But later when Mrs. ****** asked Mr. ****** about it he said that nobody came in and no one was allowed until Monday. Then Mr. ****** continued to say that his secretary never said that to Mrs. ****** because she does not know what is going on because it is not his secretary’s work. List of stolen items: Bedroom 1 (master bedroom): - Hard pink piggy bank with a fake crown on its head (in picture 1). Inside the piggy bank was $5000.00 in bundled 100 dollar bills and a handful of change/bills kid savings averaging another $300.00. - They also opened the small piggy bank and took the $200 of my wife savings and left the piggy bank. - Black Bag with a (black)Notebook PC ASUS ADP inside Model# X202E, Serial# *************** $ 450 -Japanese/English electronic dictionary $150 -Kindle electronic Nook book (Barnes and Nobles)$250 -Samsung galaxy Tablet (sprint) 1 month old not use $300 -Important documents from Japan/US includes the original papers of our daughter adoption paper $350 -Hospital records of my wife from Japan $60 - Jewelry all inside the jewelry box from Japan 24k gold queen ********* coin surrounded with ruby stones with necklace 18k, ring, bracelet, earrings 18k gold and platinum. Bedroom 2 (kids room): - (black) Sony Laptop (bought in Japan so it has Japanese writing where the power labels are): $450 - (silver) Flute in its black case. $400 - Pink Watch $50 Bedroom 3 (kids room): - (red) Bass Guitar, Model: ******* (in picture) $800 -(red) Electric Guitar (5 string) (in picture) $500 -(wood) Acoustic Guitar Model: Yamaha $200 - all 3 soft cases to each of the guitars, the ******* bass soft case has a red “Mars Music” company logo on it which is very distinctive. “the company went out of business about 15 years ago and don’t make products anymore. $200 These are the missing things that we figured out, but not quite sure if it is everything. Damage: Window screen in the bathroom $50 Drawers handle $10 What we would like to happen: We hope that the TURBO company or its subcontracted company has Insurance that will cover the expenses of the losses and damage. The police also informed us to file a case against the TURBO company through the better business bureau as well as file a case against the TURBO company at the court house for negligence. The police instructed us to file a case against the company with BBB; Police case# ******* , POC Officer C. ****** ***

Desired Settlement: TURBO company refund us the amount of the repairs and stolen items or amount of the stolen items due to there negligence of not locking the house properly during the fumigation of the windows. but we the ******s strongly believe there is foul play in which the TURBO company or its subcontracted company was involved in the robbery.

Business Response: On December the 5th 2013 Turbo Termite & Repair went over **** ** **** *** ******** ***** **
***** to do a termite inspection for the real estate agent by the name of
**** ******. These are inspections that are required by the bank to be done before the house or 
building is sold. We received a follow up phone call from ***** people to go and fix everything 
that was found on the property that needed to get fixed before the closing of escrow. The house 
needed a fumigation and wood repairs. Before going out to the house Turbo Termite & Repair office 
contacted the owner of the property to schedule and appointment for the inspector and the homeowner 
to meet so they can go over all the paperwork that needed to be signed and dated. Also on this 
meeting the inspector  goes over the paperwork  with the owner and explains everything that going 
to take place.
At the same time as they are going over the items the inspector is also having the homeowner sign 
and date everything that they went over. The inspector also gives the homeowner  a copy of 
everything that they went over. And the inspector  also mentions to the homeowner to please go over 
the paperwork on their own time again and if they have any questions to please call me. Everything  
that was done on the property as far as work is concerned the inspector went over it with homeowner 
 and they agreed to it sign the papers and dated them.  Thank you for your patience and please feel
