Complaint: San Diego Painting spray painted over sprinkler heads in my condo when they removed acoustical product, re-textured, and painted the ceilings of my residence. The painted sprinklers (all located in remote areas, closets and laundry room) were discovered by **** ***** **** ********* when they performed an inspection of our building so a 5 Year Renewal Certificate might be issued. I had 4 sprinklers that were painted by San Diego Painting, the replacement cost is $625.81.The owner of San Diego Painting came to my residence october 26, 2011 to see for himself the sprinklers in question. At the end of his visit he offered to pay me $500.00 to compensate for any damage his company might have done.I have called and left numerous messages to speak with the owner about when to expect payment for my damaged sprinklers. When the owner of the company finally called me back February 2, 2012 he told me he had spoken with his workers and that they had not damaged my sprinklers ( they are they only company that has done painting in my home). And that he felt that he owed me nothing...or that maybe he would pay me $300.00, half the replacement cost. To date I have received no compensation..nothing towards the cost to repair my sprinklers.
Desired Settlement: San Diego Painting should pay $625.81 the replacement cost of the sprinklers that they damaged. Sprinklers do not operate in a fire if they have been painted.At the least, San Diego painting should pay me $500.00 as the owner offered...he made this offer when he examined the sprinklers his workers damaged by painting them.

Dear Mr. *********,
We are in receipt of a complaint filed against San Diego Painting by you (referenced above). The complaint was filed with the Better Business Bureau on February 6, 2012. We first received notice of this complaint in a letter dated February 21, 2012, five days after a settlement check in the amount of $300.00, dated February 16, 2012, accepted and cashed by you on February 17, 2012. Thus, I had assumed this matter was resolved.
In February of 2008, San Diego Painting completed a contract with you for acoustic removal, retexturing and painting of the ceilings in your residence located at **** ***** ****** ***** *** ****** ** *****. In October of 2011, almost four years later, we were contacted with a claim that we had painted over fire sprinklers located in closet areas in your home.
On October 26, 2011, I met with you at your home to look at the damage we had allegedly done. At this time, I did not have your job file with me to confirm any details of our contract with you; I was there to visually inspect the areas in question. While I was there, I suggested a settlement of $500 under the assumption that we had possibly caused said damage. During my inspection, I did note that the acoustic material was still on the ceilings in these areas as we did not do any work to either remove the acoustic or paint the ceilings in the closets.
Upon my return to the office, the next day, I reviewed your file and verified that we did not do any work in the closets of your home. I also noted that the painting crew who did your job is one of our best crews with a long history of exceptional performance and no complaints for workmanship of any kind.
During this investigation process, I concluded that there is simply no evidence to prove our liability in this matter. There is no way to determine whether the sprinklers had been painted previously or since the time of our contract, especially after four years-time had passed. We have an industry-standard one-year warranty on acoustic removal and painting.
As a consumer, you have a responsibility to make claims of damage or warranty in a timely manner. A customer cannot call a contractor four years after completion of a project and claim they cracked a valuable vase or spilled paint on a carpet as too much time has passed to reasonably prove liability.
When I was in your home to meet with you in October 2011, I did not have all the information necessary to make a decision and upon further investigation, determined that we should not be liable at all. When we spoke again On February 2, 2012, I explained to you that we were not liable for any damages in your home, there was no evidence to prove our liability, and that I would not refund you $500 as previously discussed. After continued argument on the phone, I agreed to split the cost with you as a show of good faith, and I submitted a check request for you in the amount of $300. This was above and beyond any legal requirement and was done in an effort to avoid further escalation of this issue, either in court or with the BBB.
Four days later, before a check could be processed and mailed, you filed the above-referenced complaint with the BBB. This was, in my opinion, unreasonable. Your acceptance of the $300 payment should provide adequate closure in this matter.
