Complaint: I hired McCarthy Transfer & Storage to move my belongings from within San Diego county,CA. During the move, the movers damaged many of my belongings and also caused a marble table to be missing from the items delivered to my new place. Before the move, I bought moving insurance from After I found out about the damaged and missing items, I told ****** ******** about them. He told me that since I have insurance, I should just contact the insurance carrier, and they will go after him.My claim to the insurance carrier was mostly declined based on the fact that they calimed the mover did not pack things properly. For example, paintings, statues have to be packed in special boxes or crates. Also, they claimed that the damages were not listed on the freight bill.McCarthy Transfer & Storage was on the list of approved movers on *******************'s web-site. As an approved movers, they are supposed to have the qualification and know-how to conduct a move to its full customers' satisfaction. They are supposed to be monitored on a regular basis and checked by *******************'s Risk Management Department for their loss history to make sure they satisfy the insurance carriers' guidelines...I hired the mover to pack and move all the insured items. They should know what they have to do to satisfy the carriers. They should know what paper work they have to fill out. Evidently, McCarthy did not do the right thing: the movers damaged and lost my belongings, they did not take care of the paper-work that are necessary.In addition, they did not ensure that I have the booklet "important information for persons moving household goods within california". By law, I am eligible for a refund from McCarthy for $100 for not giving us the booklet.

Desired Settlement: The damage to my furniture, paintings, statues and the missing marble table amount to $12,350. I mailed McCarthy Transfer & Storage a list of the damaged and missing items and the replacement cost. Together with the refund of $100 for not giving us the booklet on moving, the total I am claiming is $12,450.I think it is fair for McCarthy Transfer & Storage to send me a cashier check of $12,450 for my compensation.

Business Response: This customer purchased additional insurance via a third party, *******************. We did correctly crate the items as required. The other boxes were not packed by McCarthy Transfer & Storage and thus not covered by *******************. The customer did not ask us to provide packing services of any items except the crated items  If the rest of the household goods were improperly packed, it was by the customer thus the denial of claim by the insurer.

In regards to the missing items, this was a one day move. The customer was with the movers at the origin and destination. The movers did not make any additional stops during the transport from the old residence to the new. The truck is used on a daily basis and is cleaned out of all equipment and supplies after every job.
No unclaimed items have been found that may belong to the customer.
****** ********, was present at the end of the move and with the customer physically walked into the back of both trucks used during the move at the end of the day and inspected both vehicles. No loose or "missing" items were found.

Attached you will find a copy of the Bill of Lading.  On this document the customer did not claim any items of exceptional value and agreed to a valuation option of 60 cents per pound per item per PUC guidelines. The customer has not supplied a detailed listing to McCarthy Transfer & Storage only a demand for a large dollar amount not claimed on the BOL.

The customer has attempted to place a stop payment on her credit card payment. Per PUC regulations in the, Important Information for Persons Moving Household Goods (within California) (attached). page 8, if this payment is revoked in full or in part, the basic liability will not be valid.

I have reviewed the response made by the business in reference to complaint ID *******, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

McCarthy Transfer & Storage did not present the truth of the facts:

1. I hired McCarthy to pack/prep all of our belongings that are on the insured itme lists. These items were moswtly large, bulky and heavy household furniture pieces such as mattresses, sofas, tables,ect.; as well as delicate items such as bit statues, big paintings and mirrors. ****** McCarthy walked through the house with me and noted all the items on a list. McCarthy was well aware of the fact that we bought insurance from ******************* for these items. As an affiliate of ******************* and an approved mover, we were assured that McCarthy was knowledgeable about packing/prepping requirements. ****** McCarthy personally assured that they would pack/prep my belongings according to the requirements of *******************.

In McCarthy's response, he claimed that I did not ask them to pack anything. That was a lie. Who, in his right mind, would ask the mover NOT to pack anything if the insurance company specifically stated that all insured items must be packed by the professionals. I am not a mover. My husband and I would not know how to pack/prep say a mattress or a dresser or a painting, nor would we have the strength.

During the move, I questioned in several occasions the way the mover's employee packed/prepped my belongings, but they did not listen to me, insisting that their way was the way. There were 5 of them, we felt so intimidated by them and were helpless as to what to do.

2.  We did not follow the trucks as they made their way to the new place. We had to stay behind for about 8 minutes. By the time we got on the road, they were nowhere to be found. The distance between the 2 places was only 42 miles. On that day, it took us 35 minutes to get to the new place. But it took the trucks 2 hours. What they did in that time was a mystery to us.

  I did not get into the trucks to inspect, as claimed by ****** ********. In fact, he did not allow me to get into the trucks claiming liability reasons. I only looked into the truck. All I could make out was piles and piles of blankets because it was very dark. If there were anything underneath the blankets, there was no way for me to find out.

3.  At the end of the move day, ****** ******** showed up and rushed me to sign the bill of lading, saying that the movers are tired and wanted to go home. He did not want me to go through the house to check if things were damaged or missing. He stated that we had nothing to worry about since we had insurance. If anything was damaged or missing , insurance would take care of them. He mad it sund like we had no risk because we had insurance. We were duped into thinking that he must know what he was saying.

4.I called ****** ******** 3 times to let him know about the damaged and missing items. Every time he just stated that it was between us and the insurancecarrier. He claimed he could do nothing about our loss.

5. McCarthy lied when he said in the response to BBB that he did not receive a list of damaged and missing items. I sent him a registered letter with a detailed list of damaged and missings items and he received it. But, to this day, I have not heard from McCarthy about that letter nor had he contacted about our loss.

6. McCarthy did not provide me with the booklet "Important information for persons moving household goods within California". Thus, at the time of the move, we were not aware of our rights,nor were we aware of what to look out for. By law, the mover has to provide the customer a copy. By failing to do that, McCarthy by law has to refund me  $100 as a penalty.

7. I did not put a stop payment. It is only a hold pending investigation. It is a means to get McCarthy to come to the table. Otherwise, it is like talking to a stone.

My goal is and has always been for McCarthy to compensate for my loss. To that end, I will do what it takes. It is time that McCarthy realizes that this BBB venue is a good place to make good its promise, i.e. to provide me with professional moving service and to treat me,the customer, with fair business dealing and in good faith.

I have reviewed the response made by the business in reference to complaint ID *******, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[There are 2 unresolved issues that I would like McCarthy Transfer to compensate me for :

1. Missing marble table:

I phoned McCarthy Transfer & Storage the morning immediately after the move to inform them of the missing marble table. The insurance company did not compensate me at all for this. Yet all I know is that it was moved from the old house and not delivered to the new house. It is part of a set of marble tables customarily made for us. I would cost us over $900 to have one made. Since I only put in a claim for $600, I will settle for only $600.

2. I am entitled to $100 refund from McCarthy Transfer for not providing me with a copy of the booklet "Important Information for persons moving household goods within California".

That is a stipulation by PUC. I did not receive the booklet and I did not initial on the bill of lading acknowleging that I received it. For some unknown reason, McCarthy kept pulling out this form that said "I, **** ********,....." to the effect that I received the booklet and had a signature of someone else other than MINE. If the form is purported to be from me , then the signature has to be MY signature. A signature from anyone other than ME is not valid.

Therefore, unless McCarthy would send me a check of $700 to cover these 2 unresolved issues, I WOULD STILL CONTINUE TO PURSUE THIS MATTER. UNTIL THEN, THIS CASE IS NOT CLOSED IN MY BOOK.

(NOTE: COMPENSATION FROM THE MOVER'S OWN INSURANCE IS ONLY 60 CENTS PER POUND, which works out to be a puny amount compared to what the compensation would be from the third party insurance that I purchased from ******************* had McCarthy handled the move properly.)
