Additional Notes

Complaint: EMS Paving replaced my driveway in June 2012. Unfortunately, several issues developed with the driveway including pooling of water and sinkage in certain areas. EMS was aware of the pooling immediately after completion of the project however stated that they corrected the problem by creating a groove in the driveway which was done with the toe of a boot. The driveway has become cracked and extremely uneven. The initial quote called for a gravel foundation however when they removed the old driveway they informed me gravel was not necessary as the foundation was very solid. I have made numerous unsuccessful attempts at contacting EMS. I was able to speak live with an individual in the office on 2 occasions and was told someone would come to my residence to look at and rectify the issue. This never happened and my phone calls/emails are no longer returned.

Desired Settlement: I would like for EMS to come to my home and look at the driveway with me in order to arrive at a solution

Business Response: After speaking with ****** ***** from the company on 10/1/13 he stated he would contact the customer directly to set up a time to fix the issues.

BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved

Additional Notes

Complaint: On December 8, 2012, I employed EMS Paving to seal my black top pavement driveway and paid them $500.00 for their service. A few days later, and after a rainfall, I noticed a brown materiel seeping from the cracks which they filled prior to sealing. This material really left the driveway looking terrible. I had them come back to fix the situation and they said that it was dirt and that I should power wash the driveway. I informed them that it was not dirt, but something from the filler they put in the crack was seeping out. I then asked them if they would like for their driveway to look like that and they responded "no". I asked them to come back when the driveway was dry and look at it. They returned and tried to cover the areas where the brown material was (which was most of the driveway) and after they were through I told them that we would look at it after it dried. After three attempts to have the driveway done correctly, the driveway now looks like someone has taken a brush and painted brown strokes on it . This is unacceptable to me. I have taken pictures and can provide you with same if that will be required.

Desired Settlement: I want the driveway to be sealed with a proper material to make it look black like it is supposed to.

Business Response: After speaking with *** *****, he stated that he would like to resolve the issue for the customer. He will be out of town until March 3rd, but will schedule a time for him to come out after that to take a look at the driveway. He is willing to perform whatever needs to be fixed or repaired.

Business Response: After briefly speaking with Mr. *****, he mentioned that he will be contacting you within the week to set up an appointment. He is waiting for the correct weather in order to work on the driveway.

BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
