The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

On August 14, 2019 the United States Department of Justice Office, Western District of Pennsylvania announced the 17-count indictment on Andrew Gabler. The indictment states that from in and around January 2015, to in and around January 2019, Gabler falsely indicated that customers made a down payments, falsified and inflated the income of customers when submitting auto loan applications to financial institutions on behalf of customers. In addition, Mr. Gabler had extended warranties to be sold to customers buying a vehicle at Lakeside Auto Sales and deliberately failed to remit the paperwork and payment to the extended warranty company. Further, Mr. Gabler falsely reported vehicle sales to General Motors for vehicles that had not been sold in order to obtain expiring incentive rebates. Finally, Mr. Gabler deliberately did not inform S&T Bank when Lakeside Auto Sales sold a vehicle that the dealerships had purchased utilizing S&T Bank’s floor plan financing in order to delay and attempt to avoid the dealerships’ required payment to S&T Bank for the sold vehicles which had been purchased using S&T Bank’s floor plan financing.

This indictment stems from the January 2019 Federal Bureau of Investigation executing court authorized Federal search warrants at three locations associated with Lakeside Auto Group and its Owner, Andrew Gabler alleging financial troubles resulting in default of millions of dollars in loans. In a February 2019 Court order, the companies required outside oversight  as the investigation continues, thus removing Gabler from running the businesses. In the civil Case, the Judge appointed the Hillyer Group LLC as receiver and primary decision maker of  Lakeside Auto Group in January, after S&T Bank filed a number of default judgments totaling about $7.8 million. The Judge order also allowed the Hillyer Group to take possession of the business’s assets and possibly sell them to help recoup the bank’s losses.

On September 1, 2020, United States Department of Justice Office, Western District of Pennsylvania announced the guilty plea of Lakeside Auto Group and its Owner, Andrew Gabler. 

On February 11, 2021, the Department if Justice announced that Gabler has been sentenced and imposed a $5,000 fine and ordered to make restitution in the amount of $1,696,210.63 on his conviction of conspiracy to commit wire fraud.
