Complaint: I sent a check #*** for $1,110.00 on Feb. 12, 2015. My husband and I had consulted with *** ****** about filing bankruptcy. When we received the contract in the mail, we decided not to go ahead With the filing. I have been calling ****** and ********** office to request a refund. I have called atleast 7 times over the last few weeks and finally was told by someone named **** that our refund was being processed that was on 3-4-15. We have not received our refund. No one had returned my phone calls. All we want is our refund sent to is.
Desired Settlement: We just want our money refunded.
To Whom it May Conern:
The purpose of this letter is to address the complaint made by ****** ***** on Saturday, March 14, 2015 at 2:40 p.m.
Ms. ***** and her husband met with me on December 29, 2014, to discuss filing for bankruptcy. This consultation occurred free of charge. They decided to move forward with their bankruptcy and sent a check on February 12, 2015. This check was received by my office on February 16, 2015, and was deposited with *** Bank on February 17, 2015. Per office policy, all checks are accepted with a ten (10) day hold to ensure that all funds clear properly and are not returned for insufficient funds. Therefore, Ms. *****’s bankruptcy was placed on an office hold until February 27, 2015, while the check cleared.
On February 27, 2015,Ms. Doman contacted my office and informed me that she wished to receive a refund and she no longer wished to file for bankruptcy. In accordance with office policy, she was informed at this time that all refund requests can take up to 14 days to process, Since she requested her refund on a Friday, the fourteen day processing period would begin on the next business day, which was Monday, March 2, 2015. My office again returned Ms. *****'s phone call on March 4, 2015. at 9:21 a.m., and spoke directly with her, At that time, she was again reminded of the fourteen day processing period and was assured that her refund was being processed. Never at any time did she complain or comment on this time period or indicate in any way that this was problematic for her.
The fourteen day processing period ended today, March 16, 2015. This morning, a refund check was issued to Ms. ***** by First Class.Mail, U.S.P.S. and she was notified that it had been mailed by a voicemail left at 10:40 am. With that check, Ms. ***** will also receive an explanatory cover letter, a listing of all services rendered, and a copy of the fee agreement that was served on her on February 17,2015, which outlines our office billing policies. ****** and ********* followed its established protocol and we do not believe that there was any delay, unreasonable or otherwise, in the return of Ms. *****’s funds. Also, our records do not show that Ms. ***** called seven times. We show three phone calls. All of which were dealt with directly at the time of the call, or by a return call. Please let me know if you need any additional information.
