Complaint: Company had contract for ~$650,000 to replace windows and roofs. Workmanship was faulty and not to code. Company has failed to respond. (from demand letter sent on 11/13/15) Mr. *** ******** *********** ******* **** ******** ***** ***** *** ******* ** XXXXX Re: Pine Terrace Apartments *** ********* ******* **** ******* ** Work Completed on or about February 2013 Dear Mr. ********, Attached you will find copies of Countryside Roofing invoices on the Pine Terrace roofing, siding and window project and an engineer's report from Building Diagnostics dated September 16, 2015. Pine Terrace Apartments has sustained excess roof leakage and window leakage causing extensive damage to insulation, drywall paint and floor covering as well as a loss of rental income due to having to turn away new renters and relocate current renters. Based on the engineer's report, it appears that the leaks at the windows are due to improper installation of the replacement windows. The windows were field cut to remove the nailing flange. The rough opening was not flashed as required by the building code to drain water back to the exterior prior to the installation of the windows. The roofing was not installed to code as well and it appears that the TPO membrane was installed over an existing roofing membranes. I was involved in the reconciliation of Countryside's estimate with our insurance carrier at the time and as your estimate reflects, you were paid to remove the existing roofing add insulation board and install screwed in PTO system. Because the system was not installed to code and the roof drains were covered by the TPO system, the water is ponding and leaking into the building. The engineer contacted the Genflex who manufactured the roofing system and they have no record of a roof warranty for the Pine Terrace property. The engineer also contacted the City of Lawton License and Permits Division and they have no record of a permit being pulled at the time of installation. I understand that Countryside Roofing is no longer in business, but I do know that you had insurance coverage at the time of the roof installation. Please present this information to your insurer as a claim or please provide us with your insurer information and we will present this information to your insurer. Real Capital Solutions would like to resolve this issue amicably and would rather not pursue litigation. Please confirm the claim submission to your insurer and please provide us with the claim number and claim handler information once you are in receipt. Complaint: Nonpayment to supply company. Supply company has put a lien on the house. Countryside Roofing finished a roof job at XXXXX ******** **** ******** ***** ** XXXXX on or about August 28th, 2014 and has been paid in full. However, Countryside Roofing has not paid Gulfside Supply for the materials. Gulfside Supply has placed a lien on the property in the amount of $24,101.75. The owners are in the process of selling the house. I am the Realtor. We have a contract on it but will not be able to close due to the lien. This will result in a personal loss of income of over $14,000.00 *** ******** sent me a bogus Lien Release and has called me once to say that the lien was filed in error and that he is working on getting it retracted. I have left messages for him to follow up with him but he has not returned my phone calls. ***'s phone number is XXX-XXX-XXXX.
Desired Settlement: Requesting that Countryside Roofing pay Gulfside Supply $24,101.75 and any legal fees required to get the lien released.
