Description

Consumers should note, when dealing with debt collection companies, that there are obligations outlined by law governing collection practices, especially those conducted by a third party collector (as opposed to a direct employee of the firm to which money is owed). You are encouraged to seek documentation of the debt as stated by the collector. It should also be noted that a debt collection company's customer is the company to which the debt is owed, not the consumer who owes the money to that company. The Better Business Bureau processes complaints against companies as filed by their clients. As such, the BBB will make complaints from consumers known to the company, but will only pursue formal disputes against a collection agency when that disagreement is between the collector and the company with which it has made an agreement to pursue repayment. In January 2011, the company was the subject of news reports in Kansas concerning its attempts to collect debts owed to Hollywood Video stores. While Hollywood Video may be out of business, a collector may be hired to collect or purchase the debts of a company. NCS has demonstrated that the firm is obligated to collect Hollywood Video debts and maintains it is doing so legitimately in the course of its regular business. Some consumers have stated that the company has made notations to those debtors' credit reports prior to attempting to collect the debt, which may violate the law. Consumers also complain that the fees being charged by the company to collect on late fees or missing videos attributed to those consumers' accounts are excessive and unreasonable; if that is the case, the company may also have violated rules concerning collection practices limiting the amount of penalties to be charged. Consumers are reminded that just because a company has gone out of business, it does not mean that debts owed to that firm are not valid. In many cases, a company's outstanding debts are viewed as an asset, and may be liquidated as such. The new owner of that debt may then collect that debt. It's also important to note that, while some debts may become unreportable after they have reached a certain maturity, a debt is not truly considered satisfied until it has been paid off and collection efforts may continue.
