Additional Notes

Complaint: I had purchased a vehicle from Mr. ******. I purchased car on march 9th and during the original paperwork the sales agreement was messed up and was brought to ******'s attention in which he changed the contract. The date that was put as 1st payment was March 15th I spoke to them and told them that I wanted to pay monthly and **** or ****** told me it was fine. Several times myself and my Grandmother spoke to them. and the date due was changed to the 29th of march. On march 26th they came and got my car. This morning 27th went to car dealership and was prepared to pay payment. At first they were going to agree, Then the finance girl said that I was seen driving by MR ****** driving crazy in a parking lot.My grandmother asked to speak to him. Mr ****** came into room and started raising his voice and pointing his finger at me and my grandmother told him to stop talking like that and have respect. Mr ****** continued and then he said well he has put 1500 miles on the car. I told him that this was violation of a persons privacy. Once you sale a car its not your car. He was spreading these rumors around and then after he and my grandmother exchanged words she was asked to leave and they told me MR ****** wanted full payment. My grandmother was told by the girl that was helping us that he talks to people like that. My grandmother apologized for the incident but Mr ****** would not come out. I put down 1000 dollars and out couple hundred in fixing the car so it would run. This car had been stripped down and was a lemon door panels started coming off . The service that we received was unprofessional and We are going to file complaint with DMV. I want an apology for my Grandmother for the way he yelled at her and pointed his finger at her and my thousand dollars back due to mishandling of this contract. The girl ****** was not authorized to tell me that I could make payments monthly. She would be fired if she did. But she did tell me and my grandmother that.

Business Response
***** ******* purchased a 2000 Nissan Sentra on March 9,2013. Upon completing the application and providing necessary paperwork customer asked a representative of Butler Auto Resources to reduce the price of the vehicle. The representative explained we were unable to reduce the price of the vehicle. The selling price was already below the Kelly Blue Book suggested retail value. After signing the application and providing all necessary documents, he signed the paperwork necessary to purchase the vehicle. At the time of closing the customer signed all necessary documents needed to complete the purchase with agreed price and terms. One of which stated he would be paying 130.00 bi-weekly and his first payment would be due 03/15/2013. The standard policy at Butler Auto Resources requires customers to set up their payments in accordance with their pay dates. Mr. ****** agreed at the time of closing to pay bi-weekly in order to coincide with his pay dates. ********** explained that in order to pay monthly the payments would need to be made in advance at the beginning of the contract. The contract also stated that the vehicle was equipped with a Global Positioning System Device (GPS). Customer signed and acknowledged that he understood the vehicle was equipped with this device. Customers contract stated his first payment would be due on March 15,2013. On March 15,2013 no payment was received on the account as agreed. Mr. ****** was left a voicemail on March 18,2013 regarding missing his first payment. Customers Grandmother called back the same day and spoke with *******. His Grandmother told ******* *****'s employer had withheld a weeks pay from his check. One of Mr. ******'s required documents was proof of income. He provided a Harvesters Federal Credit Union statement showing a direct deposit from Advance Auto store posted on March 1,2013. His next check would be posted on March 15,2013. This coincides with his statement of bi-weekly pay. His Grandmother also told ******* that she got paid on March 22,2013 and would be making 2 payments for *****. On March 25,2013, ******* attempted to contact *****'s Grandmother regarding the broken promise to pay. Someone picked up the phone and immediately the call was disconnected. Immediately ******* contacted ***** regarding the broken promise to pay. ***** told ******* he would have the money in a couple of days. At that time ******* informed him she could not make any further arrangements with him due to missing his first payment and then breaking his promise to pay. ***** stated he did not have the money and ended the conversation with *******. After the conversation with *****, ******* immediately attempted to re-contact his Grandmother, her phone went straight to voicemail. *****'s contractual due date was never changed. On March 26,2013 the customers vehicle was removed from his place of employment. At the time of removal *****'s account was 11 days delinquent. Upon our examination of the vehicle we determined ***** had driven 1500 miles in the 18 days he had the vehicle in his possession. The car's oil change sticker was removed and there was excessive wear on the front tires. On March 23,2013 while **** ****** (owner) was purchasing gas he witnessed someone speeding recklessly through the gas station parking lot in Gonzales. **** ****** is a older man and requires the use of two hearing aids and speaks at a high level due to his hearing loss, no disrespect was intended. We required full payoff due to our concern regarding the condition of the vehicle and the customers lack of concern regarding the payments.

*** additional information **** 4-2-13
Adding to previous message of today to Mr ******'s response, I am not accepting his continuous lies and i want to know why all the conversations we had over the phone was not in computer only the ones that benefited them. Now if I was wrong in my actions I would own it but I am not I was also told today by an employee that they were not surprised about the pot smell because they know of a mechanic that has been doing that for a while. All the information that we are being told is coming from Butlers own employees. I was told that the car I purchased had been sold many times over and the way MR ****** makes his money is to do things like this. I have spoken to several other personal car lots and none of them put GPS systems on their cars and they do not repo car except if many weeks behind after no agreements are tried . They say no arrangements were trying to be made that is lie I talked to the at least twice week trying to get things done. And today i was told by one of the employees that they never have oil stickers on cars because they don't care about that. again I am filing suit against them for the mis-truths they are saying and the treatment I received because I am a young Hispanic man that they took advantage of thanks for this amendment n0t to the one sent today ***** ******

I do want my thousand dollars back and an written apology for my Grandmother,I am taking this all the way to report his misdealing

In response to this outrageous response. I never asked for the price to be reduced,On the Saturday I went in my Grandmother was not even there. I had noticed that ****** had over charged me and this was brought to his attention and contract was revised. As for my grandmother paying on the on the 22nd she doesn't even work and had no idea what they were talking about. They called my Grandmothers phone while she was at Sacred heart and she was not able to answer her phone. They left two message which are saved asking her to return call. She was told that she was not on contract and had no right to any conversations regarding contract. I called ********* several times with witnesses to the date of my payment since My employer held out a week and I did not have the funds at time due to that. She also told my Grandmother that the 29th I could pay the full amount . I was not driving through the gas station which is on Kingsfield road in cantonment. He first said I was on old Palafox and almost ran over curve which is a lie. The reason he demanded full payment was because he started yelling at my Grandmother and she stood up to him, before this occurred they were willing to take payment to bring up current. Since this has occurred We have been approached by employees and told this is a practice that is used very often. ********* refused to admit what she said due to being fired according to *******. The truth is we were told by ********* that the 29th would be fine, The oil sticker was not removed and the tires had no excessive wear and tear on them I had put a new radio in the car due to all wires and radio being stripped out.

Mr ****** has a reputation among the employees as a harsh individual and as ******* said he yells at everyone and treats everyone that way. I have been told by others that have purchased vehicles that this practice is routinely done by this business. My Grandmother never told them she would pay anything. She did say she would make sure i made my payment on the 29th. She was told at time from mr ***** that she had no business doing anything and to leave. She has two recordings from their office discussing this matter with her.
I was not reckless driving and if I were it was not his business since I was purchasing car. Also the car was at time of purchase looked over by deputy sheriff and was told at time that someone previously had pot in the car because as he was looking car over the smell was very strong. He suggested that we take car to sheriff office and turn them in. But we couldn't prove who or where it was in car. Now yes he does owe my grandmother an apology to the way he spoke to her and told her to leave because she had no business in the office when ******* asked her to come back there. Then we were told about the Gps and them tracking the car. This is in violation on privacy. on contract the mileage was exempt and no reading so how was the mileage calculated. No way I put that many miles on the car in 2 weeks. This company I found out has a bad reputation and is being turned in to DMV for their practices. But the treatment that my Grandmother received was uncalled for and very unprofessional. The employees that we talked to say he is hateful in the way he talks to people. My Grandmother even before she left told ******* to convey her apologies for misinformation we received. He either doesn't know what his employees are doing or he doesn't care. This business is supposed to be christian ran, There is no way Christians would treat people. This business is doing nothing but lying and making stories as they go. Its funny that none of the notes that contained information Told to me from ********* were in computer and the conversation on the Monday where my Grandmother called up there and talked to some man about her being in hospital. No one picked up her phone and hung up because there is no signal on her phone in Sacred Heart. This is a really bad way to run a business and if the money means so much that he has to be this dishonest to people then so be it Thank You for your concern and help

Business Response
Mr. ****** is making many unfounded allegations. We have been in business in the Pensacola area for over 40 years and facilitate a drug free work environment. All vehicles we sell are equipped with GPS devices and customers are informed of that before purchase papers are signed. We record the exact mileage at time of sale on all vehicles on a Salesperson's checklist. The mileage is recorded in order to keep track of our warranty. When the paperwork is printed either mileage or exempt is printed on all documents, whichever is on the title. The vehicle was a trade in at Sandy Sansing Chevrolet. We purchased the vehicle from Sandy Sansing Chevrolet at Americas Auto Auction in Pensacola, FL. Mr. ****** was the first and only customer to purchase the vehicle after it was professionally detailed. The majority of the money Mr. ****** paid as a down payment went toward sales tax, tag and titling fees. Mr. ****** reported no problems or concerns with the vehicle until it was removed from his possession and the payment due was required.
