Complaint: Filed bankruptcy chp 13 in 2008/. Worked hard paid off all creditors early. Wages Were "over garnished " and a refund due. Lawyers kept refund
I kept every piece of paper sent my way concerning the case. There was a period of time Iwages were being garnished from both of my places of employment. I had tondo the leg work and notify those concerned The creditors were paid Almost $4000.00 was left over. Trustee website a check was to be sent to me The law office of Lewis and jurnovoy decided they would now charge me more therefore I would not get the money from the trustee. I plan on notifying the state attorney office in Tallahassee. I paid the lawyers in cash prior to case going to judge. The trustee also paid L & J. Kinda sounds lijke "double dipping". In the mean time car broke down ask L&J office for late requesting to incur new debt to buy car. I was told case almost over we won't provide that. But they sure want my hard earned money which I could use for vehicle to go to work as a nurse. Working 60-70 hours per week to pay debt. I am veryvsaddenedvby the way that they handled the case by my receipts they charged and received $3,000 from me $3,300.00 from trustee and now keeping my refund from "over garnishment" of $3600.00. I owed $45,000 to creditors had to pay lawyers almost $10,000. WOW. People beware

Business' Initial Response
Thank you for forwarding the complaint received by you and regarding my law firm. I must say that I was shocked to see the complaint because I do not recall receiving any complaints in all of the years that we have been a member of the BBB.

We take the complaint and its allegations seriously. My law firm strives hard to represent people in an honest and open manner. There are never hidden fees or costs.

This case in particular involves a bankruptcy where we were retained to represent the client in 2008. We have reprsented this individual for almost 5 years. When our representation began, the client signed a retainer agreement which stated specifically the legal fees involved. Much time and effort were expended trying to accomplish the goals outlined in the original agreement. When we were unable to proceed as planned under the original retainer, we signed a second retainer agreement which quoted more legal fees due to a different type of case being handled than originally contemplated. We went from a possible 4 month case to a 5 year case. This is a big difference.

When the bankruptcy case was filed, all of our legal fees were disclosed to the court. This is standard procedure in bankruptcy. We disclosed the monies that were charged under the initial retainer and also the fee charged for the case which was filed into the court. In 2009, the Court approved the plan we had proposed for our client. Our job was over in the case other than routine monitoring over the next 4 years.

Subsequent to the court approval, the client began to have problems complying the with the court ordered plan. These problems continued for the next 4 years. The problems were due to the client's own circumstances and resulted in their being contant challenges to her case inclduing motions to dismiss, motions to foreclose on her home and to repossess the client's auto. Every time a creditor or trustee challenges the case, then more legal fees are incurred. As the lawyer, we must constantly review these matters, respond to them, corespond with the client, file legal pleadings, and attend court hearings. The client was well aware of all of the problems because she received copies of all the motions and hearing dates as well as letters and telephone calls from my law firm.

Even with all of these problems in the client's case, we continued on in our representation. We could have filed a motin to withdraw as the attorney. We chose to stand with our cliet and address the continued problems again created by her own circumstances. This was very time consuming.

We have all of our time records in the case. There is a court docket which shows all of the activity in the case over the entire 5 years. We have offered for the client to come in so that we can review her file and our time with her. We are also mailing her our time records with a copy of the court docket. Our records show that we were owed significantly more money than we charged the client. We significantly reduced our fee to try and stay in line with our retainer agreement even though our agreement allowed us to charge more fees.

When her case was Discharged, the client contacted one of my paralegals and thanked her for all the hard work we had done on her behalf. It was not until we sent her the letter regarding the legal fees that she filed this instant complaint.

We have no ill will or misgivings towards our client. I stand by my legal work that has been done for the client and also by the result which was reached.
