Problems with Product/Service

Complaint: I purchased a home from Ben L**** (DBA ****** ***) and Don L**** was the agent. We were told there was an HOA for our neighborhood and that there were CCR's. We signed all the documents at closing. We have since found out there is not a binding HOA and no CCR"s and now new builder's are not building homes that meet the minimum requirements of the CCR's that were signed by the buyers in our neighborhood. Neither Ben nor Don have offered any explanation or relief in this matter. It is my opionion that they purposely mis-led myself and all of the other home buyers in the *** ******* developement.
Desired Settlement: Leske realty should pay to have new CCR's drafted so that we are protected to the levels that were outlined in the documents we signed at closing.
Business Response: The home buyer purchased a home in a development with "recorded" CCR's which were recorded on title at the time of purchase. He received a full copy set of the CCR's which he signed. He received a full copy of the title report as well. Everything was transparent and everything was correctly disclosed. The home builder that built Mr. ******* home has sold all of their lots and are no longer building in this development. The buyer has a problem with the "new" builder that is currently building homes. The buyer should seek legal council and discuss this matter with his attorney. Perhaps they should notify the new builder that the homeowners feel the new builder is not adhering to the recorded CCR's of the development. -Don
