On August 27th I was talking to ************ employee, ***************************** on the phone and I asked if any used boats of a certain make and model were available at his dealership. He told me that one matching that make and model had just been left at their dealership and was available to purchase. Later, ************************** sent me photos of the boat, which appeared to show a boat in good condition and free of major damage/corrosion. ************************** then took a $1,000 deposit from me over the phone. I drove 4 hours to see the boat and noticed some staining on the aluminum boat hull that appeared abnormal. Worrying it might be corrosion, I brought it to Mr. ************ attention and he told me he thought it was saltwater residue. I took photos of the discoloration, compared them to online photos of corrosion, and also sent them to a boat surveyor who said that the marks appeared to be corrosion. On September 7th I had not taken possession of the boat and notified ************************** that I was no longer interested in buying this boat and requested my deposit back. He replied that the deposit was non refundable, that he believes the discoloration is not corrosion, and that no boat surveyor worth their salt could diagnose corrosion by looking at pictures. ************************** maintains that Im not entitled to a refund despite the fact that this no refund policy isnt listed anywhere on any papers I signed, the product being sold was not represented accurately, and to my knowledge has not even asked his manager if they can refund my deposit.
