Complaint: Roofers left my roof exposed to rain. Severe water and mold damage occurred. Workers also damaged interior and exterior areas. Roofer has no insurance On Nov. 13th the roof was to be repaired. ****** ****** (owner) said it would take 2 days max. We talked about rain to come in 3 days. He said it would be done before storm. I explained that I had been exposed to black mold years ago and that was my number one concern, my health. Workers did not remove entire roof as scheduled. It took longer than ****** had anticipated. Once paper was down, I called the exchange and said they needed to tarp the house due to the rain coming. A worker came out and looked at the roof and said there was no need. I argued he was wrong and made my concerns known. That night at 2 a.m. I awoke and went into the garage. The roof was leaking. I called the exchange and ****** came at 3 a.m. an partially tarped the roof. It continued to rain so shingles were not put in during the next couple of days. Workers returned when it cleared up and put on shingles. Several days passed and the water damage became evident. I called ****** and he said he would come look. 2 days later he came. He said he wanted his "Buddy" contractor to take a look at the damage both upstairs and downstairs. I did not hear from him as promised. The following Friday there was a large storm. I called a water restoration company and they said to tarp house asap and remove molded drywall and insulation. I sent ****** an email and demanded he tarp house. No response until the next day. ****** showed up with his friend from another water damage company. They removed large portions of my house that were wet. A dryer was left for 3 days to get rid of moisture. His "Buddy" said that it was fine and I raised my concerns over black mold. They agreed to have it tested. A company confirmed that there is indeed mold throughout the home. We are working presently to schedule toxic mold cleanup. I had to pay for a hotel as the home is not habitable. (65 dollars I would like to be paid back)I have excessive PG&E charges due to the running of equipment. I am now displaced and living in a hotel. I have contacted my insurance company. I would like a refund of the 3 thousand dollars I gave ****** as a deposit. The roof has been inspected by another company. Repairs to flashing need to be done as the flashing is incorrect. Owner, ****** said he has insurance to cover damages but that was a lie. He has not had insurance for 2 years. His business cards state he has insurance. I would also like 1 thousand dollars to pay for my deductible for the extensive work that ****** be done. The entire scope of the damage ****** be investigated by the mold hazmat company.

Desired Settlement: Hotel charge (65), Electric charge (100), deductible (1000), deposit (3000) I want him to obtain insurance to protect other homeowners.

Business Response: Business' Initial Response
On 11/13/12 ****** ****** met with ****** ****** and a contract was signed to do a complete reroof of the house not a repair as stated in the complaint. The contract price was for $ 6,195.00. We asked for a deposit upon signing of 10%. The client wrote a check for $ 3000.00 stating that was what she would like to do. That left a balance owning of $ 3,195.00. There was some disussion about how long the job would take and the weather conditions. I told her that this size job normally takes two days. This is a common question and we try to meet epxpectations but there are circumstances that ****** be out of our control. This roof had two layers of shingles with the second layer coming off in little pieces. This slows the process down and there is no way of knowing up front the condition of the layer. Work started on 11/14 as promised. We removed the existing shingles and felt to get down to the wood deck. The majority of this part of the job was completed by the end of the first day. On 11/15 the removal of the old roof was completed and shingles were loaded on the roof. 11/16 Work continued and by the end of the day the entire roof had felt paper"dried in"as the trade refers to it, and three of the six roof slopes were shingled. No open roof deck was exposed. We didn't put tarps on the roof because they have to be batted and nailed down or they ****** blow off in the wind. This would create more holes in the roof and damage the shingles that had been installed. It's more common practice to felt in the roof rather than use tarps. We had some rain and wind that came in that night. I received a call from the service that there was a leak at 12 Rainier. Myself and another employee arrivedat the house at 2:30am to check it out. We found water marks on the underside of the roof in the garage which was covered with felt paper. At that point with no way to see what was happening we decided to cover that side of the garage with plastic. We went and checked the upstairs attic space but found no evidence of any leaks. There were no other accessible attic area downstairs that we could check and there was no indication of leaks anywhere in the house. 11/17 Saturday the roofing work was completed by mid day. From this day forward there is no sign of any roof leaks. 11/21 6:33pm the night before thanksgiving day we received a message from ****** ****** that she was concerned about wet sheetrock in her upstairs bathroom and downstairs ceiling. ****** ****** replied to her message the next day and setup a time on Friday 11/23 to inspect those areas. 11/23 ****** ****** came overto inspect the upstairs and downstairs areas. Again I looked in the attic upstairs and didn't see any water active roof leak. There was no way to heck inside the space downstairs because there is no accessible attic space. ****** ****** contacted ******* of Chico a local professional water damage restoration company. I don't know where the idea of "his Buddy contractor" can from but we hired a professional company with ****** ******'s approval. ****** ***** of Serpro measured the moisture levels with a meter to determine the moisture levels in the sheetrock. At no time did h or the other professionals use the words "severe water and mold damage". The only area where he found a saturation leel upstairs was in the bathroom over the tub. All other ceiling areas were at normal dry levels. He suggested that a portion of the sheetrock be cut out and the insulation be removed in this area above the tub. The other area that showed saturation levels was on the ceiling downstairs. He again suggested that this portion of the sheet rock ceiling and insulation be removed and dehumidifiers be setup to run for a couple of days.It was suggested that it should be done as soon as possible. ****** wanted to take some time to consider this and call me with her decision. ****** did agree a few days later to let ******* do the job so they started on 12/1 and completed it on 12/3. After the three days Mr. ***** of ******* did a final heck of moisture leels in the two areas and found them to be at normal dry levels. There was no harmful mold detected as a result of these leaks. Cost of the job $ 893.92 paid in full. We hired a second company ******** Environmental Services with ****** Clarks approval to run some air samples and make recommendations. There was no indication of "Black Mold" in the samples. ****** ***** of ******** suggested that a fogging treatment be done to scrub the interior before replacing te insulation and sheetrock. The fogging treatment was not done. Cost of services provided from ******** Environmental Services $ 1,575.00 paid in full. We did pay for a room at the Holiday Inn on 12/15 Saturday while the fogging was to be done at ******'s request. Electric ****** Charge: I have no problem paying for any excess electric charges due to the fans but I would like to see last year's ****** or some documentation to determine the extra expense. We have finished the roofing job and there is a owning balance of $ 3,195.00. All materials and labor have been paid in full. We ****** continue to stand by our work and don't believe there is anything wrong with the flashings. If an inspection was done by another compay I would like a copy of the report and its findings. We know of two leaks in the roof during the process of the job and they were eliminated the very next day when the roof was completed. We took appropriate steps to work with professionals to remove the wet sheetrock and insulation as soon as we could. We have been shown no evidence that the any mold was casued by these leaks. On 12/16 we tried to setup a meeting to discuss the on going repairs but on 12/17 ****** decided to go in a different direction. I have not heard any more about this. We take this matter very seriously and was not aware of this complaint filing until I received a email message on 1/7. We have been in buiness for fifteen years and have no complanits about our work with the hunderds of home owners we have worked for. It is very important to us that we maintain a high level of satisfaction and continue to get the majority of our work from referrals and we are very proud of that. Chico Roofing Company currently has a General Liability Policy. We would be interested in a reasonable reolution to this matter.

Consumer's Final Response
(The consumer indicated he/she DID NOT accept the response from the business.) Bottome line is this: 1)Roof leaked causing severe damage. 2)I am asking for insurance information, I am aware of the bond which is not the same thing. My adjuster was told by ****** that he has not had liability insurance for 2 years. 3)I want all money paid returned. 4) The stress that this has caused my family is seve.

I am standing on the comments that I made in the initial response. I tried to create a timeline in my initial response to show that we acted in a timely and professional matter when dealing with this situation. I had to rely on the companies we hired to get me on there schedule as quickly as possible (******* and ******** Environmental Services). We have not been paid for the roof at this time and I don't think her requests are at all resonable.
