Complaint: Lying about rental application
If I could give them zero stars I would. We applied for a place. Was told our credit and income looked good and to give 30 days notice where we were. The next morning we turned in our 30 days notice and a couple hours later we received a call stating that our credit wasn't good and we were denied. Now hoping we can get our 30 day notice back. Felt lied to and jerked around. Would not recommend.

After rewieving the applicants complaint, my findings are as follows: 1) The issue with the credit was the overall score from both applicants were below what the Property Owner would accept. In addition Ms. ******'s current landlord would not complete are verifaction questionary without receiving a 30 day notice from resdent. There is nothing I can do as far as the 30 day which her current Landlord requested to allow us to complete their application.

In short, I have approved for Ms. ****** to stop by our office and her application fee will be refunded.
We will call Ms. ****** and inform her of the refund.

Complaint Resolution: Company resolved the complaint issues. The consumer acknowledged acceptance to BBB.

Complaint Category: Failure to honor a contract or agreement

Complaint: I paid $850 deposit, during the walk through the Select agent said everything looked good, but now is keeping our deposit and charging us $143.
My husband ******* ********, my mother ******** *****, and I ****** ****** rented a condo with select, **** W. ******* Rd. #1, Yuba City, CA. XXXXX, we paid $850 move in deposit, did a clean walk through and now not only are they trying to keep our deposit, but they are charging us $143. The representative ***** was asked multiple times over the phone, in writing, and in person for reasoning, and receipts, but we never receive any response. Everything ***** marked on the estimated cost sheet we have picture were that way when we moved in.

I have reviewed the move-in and move-out inspection and all photos and information available. The following is an explanation of events and findings:
1)On November 26, 2012 we received a letter requesting invoices and back up for all cleaning and repairs
2)Our agent did inform ****** ****** that they would receive copies of all charges when they received the final accounting of their security deposit.
3)Our agent then meet with the clients on December 5, 2012 and explained that the Estimate which they received showing a balance due was just that an ESTIMATE.
4)They were requested to wait until they received the final accounting of their security deposit refund, before taking any other actions.
5)We had not received all of the invoices for work that had to be completed, which is why they were not include with the estimate.
6)We have received the final invoices; therefore the accounting of their security deposit is now completed. They will be receiving a total of $371.26 as a refund in addition to all of the receipts with a full accounting of their security deposit.
7)I will summaries the charges lease expired on 11/3/12 vacated unit on 10/31/12, pro-ration of 3 days rent.
8)Touch up paint, unit was freshly painted at move-in
9)Carpet cleaning per- lease it is required proof that the carpeting has been cleaned, none received. ( Also has gum in carpet throughout)
10)Additional cleaning noted on move-out inspection.

I do beleive all final charges are justified. In closing I would like to point out that if ****** ******, plaintiff does not agree with our final accounting of their security deposit it is her right to take whatever steps she finds necessary.

When I gave Select my 30 day notice it was on November 2, 2012, ****** from Select was the one who requested we did the walk through 3 days early on October 31, 2012, during the walk through ****** said I quote "Everything looks great." And then asked for me to hand over the 2 house keys and the key to the garage. If they are charging us for 3 additional days then during the walk through ****** shouldn't have said everything looked great she should have said there was stuff wrong and to take the 3 extra days to clean it. On walk out the ONLY thing that is marked to be charged to the tenant is '"Dead bugs in entry way". I have proof where Select was willing to rent the property on 12/3/12, but yet is charging us cleaning charges for 12/6/12. When we went into Select to try to get the final paper work she refused to speak with us. We have a recording of this. I also have pictures that shows everything that they are charging us for was that way when we moved in.

I would also like to add that the invoive they sent us for paint has been altered which is illegal. Per law we were suppose to receive out deposit back within 21 days if not then the invoices within 21 days as to why we haven't received it. It took 37 days, per law we are entitled to 2x what deposit we were given since they failed to do so within 21 days, we only received $371.26. I posted a ad on craigslist asking if anyone has had problems with Select. Within 3 days I received 10 different emails from customers or ex customers. I don't care if they refuse to give me what is rightfully ours, but I would hope with this complaint that you can put a stop to the way Select is wrongfully treating people.

I am writing you in regards to your email dated 12/10/2012 addressed to our agent ******. I want to clear up several false accusations. California Civil Code 1950.5 states we have 21 days from the date of your move out to mail the accounting for the security deposit disposition. We mailed your ESTIMATED disposition on 11/8/2012 nine days after your move out. Yes, you wrote a 30 day notice stamped received on 10/2/2012. Stating you will be moving on November 3rd 2012. Patricia wrote you a letter indicating your move out date will be 10/31/2012. The mistake was made when we counted 30 days from the date notice was received instead of reading the notice to indicate the date of 11/3/2012. When you called and spoke to ******** to schedule your move out for 10/31/2012 you did not indicate to her your concern of our mistake or inquire if you would still be responsible for the remainder of your lease. It was an honest oversight but none the less we have a binding contract indicating your responsibility to the lease. We will however refund one the pro-ration of rent for November 3rd. In regards to the charges that were indicated on your estimated disposition. We do estimate high in order to assure we will have the necessary funds to pay invoices upon completion. The reduction of $325.00 for the charge of painting was a direct reflection of the actual invoice. I would like to mention the painter had recommended the unit needed a full paint job. We only requested the areas that were beyond normal wear be painted. As for the move out sheet it clearly indicated the condition of the property at time of move in and move- out. ****** did not add to it after the move out as you falsely accused her of doing. The broiler drawer is what she was referring to as far as being dirty inside not a broiler pan. The carpet cleaners indicated the gum was ground in throughout the place. ****** could not possibly track gum in and grind it in throughout only walking on the carpet one time. The cleaners had to install the drip pans they were not on properly. It was not an extra charge but, noted. When we receive a thirty day notices we always place them on Craig's list we indicated the date we expect the property to be available yours was 12/3/2012 because we thought it would be ready by then. It was not so we pushed up the date. As far as people coming to your door we did not indicate it was ready before your move out date. People took it upon themselves to ask to see inside at your time of occupancy. Select has never instructed clients to disturb anyone if you were disturbed by any persons from our advertisement; this was out of our control but we do apologize. As for the faulty light in the garage we sent Hoffman out to make repairs the day of your move in. You did not advise Select this issue was not resolved until the day of your move out.

Pool gate issue has been taken resolved

I have received a copy of both our letters and have also forwarded this information to the owner. Per- your email to ****** on December 10, 2012 you indict you would like to forward all of this information to our corporate office but you have been unable to locate our address, 437 Century Park Dr. Yuba City XXXXX

In closing you state that our agent ****** refused to speak with you, this is correct we are not required to be recorded when having a conversation with anyone. In addition we would like to inform you it is against the law to make inflammatory accusations insulting someone's character & integrity. We are requesting that the verbal badgering and faults statements you have posted online stop immediately.

Pre your email you have indicted and I quote "We are not asking for anything else from you so this is not a threat in anyway". We do appreciate the fact that you have decided not to continue with this issue.

1st of all ****** the GM hasn't even taken the time to view our pictures, nor has she asked for them. How would she know how the unit was when we moved in or out? I do have a witness as to ****** not writing all the stuff down on the move out during the time of the move out. Had she have wrote all that down and told us we would be paying for 3 extra days I would have fixed any problems she had noted, but as noted on walk out inspection we would only be charged for cleaning dead bugs in the entry way, therefor I figured well cleaning one light fixture should only be like $10, so why bother. There was not gum throughout the house as stated, I have proof of this too. I have not posted anything illegal. All that has been posted and being posted is honest and have proof to it. Not only pictures, witnesses, altered invoices, but multiple other people who have rented from Select. No we are not asking for anymore deposit, but I will help prevent other people from being ripped off by Select. The reason for asking that ****** be recorded is because over the phone she has told us one thing and later turns around and says another... Example: ****** said over the phone that the final along with receipts would be mailed the 20th, I waited and didn't receive this so I called again and was told that ****** said we were not going to be receiving the final and that we owed as stated in the estimate, we had Terri Francis Sutton fax a paper asking for copies of all invoices, nothing was received in the 7 day timely manner so we went into Select when Sherri refused to talk.
As to the owner we have sent her copies of all our pictures, along with the altered invoices, and the walk through sheet.
When the light fixture in the garage didn't work Don came out 2 different time to fix this. The 1st time he put a new bulb in one side and it worked, but the other side blew as soon as you turned it on, he said he was going to see what Select wanted done. When he came back he put a new bulb in the side that blew and turned it on, it came on sparked and went out again, he then said he would let Select know, but they aren't going to want to fix it because it is something in the wiring. Of course that was the last we heard of it. We cannot make Select fix thing they refuse to. To turn on the sprinklers you have to put a screw driver down in a hole that is always full of water because it leaks, this hole has wires. We contacted Select about this, the lawn guy came out 2 months after we 1st contacted Select about the problem and he said he requested this be fixed by Select when there was previous tenants living there and Select refused. Once again we cannot make Select fix anything.
I believe if this ****** would take the time to sit down and look through everything, not just look at what Sherri says, she would see things in a different light and maybe put a stop to the way her agents are treating their customers.

I would like to add that ****** ****** has an email from Sherri where she admits to altering the invoice. This is against the law. A invoice is considered a Legally Document therefore making it illegal to make alterations as done by Sherri.

Complaint Resolution: BBB determined the company made a reasonable offer to resolve the issues, but the consumer did not accept the offer.
