Complaint: I am complaining about the carelessness and negligence of Mid Cal Moving & Storage in moving my household furnishings from Modesto to Walnut Creek. I am complaining about the carelessness and negligence of Mid Cal Moving & Storage in moving my household furnishings from Modesto to Walnut Creek on Aug. 15, 2012. The day of the move one of the moving men brought me a large picture that had the glass broken and said it had happened in the move. They had not even wrapped it in paper. The driver was there, recorded it, and told me to notify the office and it would be replaced. In addition, the movers left an oriental vase holder outside broken. They didn't even bother to bring it in the house or tell me about it. The movers also did not attach a headboard to the bed, and they ripped a bedruffle in the move because they did not bother to take it off the mattress. I notified the company of this and they offered me $33.00. Just the glass alone cost $73 to replace. An offer of $33 is ridiculous for all 4 damages. The company said I had turned down their extra insurance, which is true. However these damages were not normal damages from a move. They were directly related to the movers' negligence and carelessness. The moving company said they would have someone come and attach the headboard to the bed the next time they had a representative in the area. That is ridiculous also. I need to hire someone to do it now.

Desired Settlement: Monetary settlement so I can replace or repair the items damaged, and so that I can hire someone to attach the headboard to the bed.

She submitted a claim on a broken vase, a glass framed picture, and a torn bedskirt. The issue is on how she was compensated for the damage. In California, moving companies are regulated by the Public Utilities Commission. Through their regulations it is assumed that the value of the goods we move is limited to 60 cents per pound per article. The customer does have an option of declaring a higher value and the mover charges a premium based on the value. This was all explained to the customer. In addition she was given and signed or initialed on 3 separate pieces of literature explaining the options. One of the forms even has pictures and samples showing what the customer would get if a specific item were damaged under each of the options. The customer made a clear and informed decision to release the goods at the minimum liability. Regarding attaching the customers headboard to her bed; if she accepted our offer of doing it we could have it put together with in a few days. The customer wants to be compensated $300.00 to hire someone just to bolt the headboard to the frame. Perhaps if she requested a much more reasonable amount we would consider it. I am sorry that there was a small amount of damage that occurred during the move, however we have offered to compensate the customer for that damage based on the option that she clearly chose.

Consumer's Final Response
(The consumer indicated he/she DID NOT accept the response from the business.) The damage was due to carelessness and negligence. I paid for the move, assuming the mover would take care in moving my furnishings. To leave a headboard leaning against the wall and not even fastened to the bed is ridiculous. Leaving a broken vase holder outside was also very negligent, as was not unfastening the bedskirt and thus tearing it. Finally, the fact that they did none even wrap a very large picture and brought it in to me, showing me the glass was broken and telling me they broke it in the move, shows that they knew it was their fault. They offered me about $30 to fix everything, which was a ridiculous amount. By contracting with me to move my furnishings, they owed me care of those furnishings and lack of negligence.

Business' Final Response
Respectfully, the customer's rebuttal offers nothing new. We moved between 500 and 700 items for this customer. Unfortunately 3 of the items were damaged. In case of damage the customer has options on the protection against damage that may occur. The customer clearly understood her options, and in order to save money she chose to take the option that would not fully protect her in case of damage. She does not dispute this fact. Now, after the fact, she wants to be compensated as if she had paid for this additional protection. If it was not explained to her, and she did not know what she was choosing, I might understand her complaint. However, that is not the case. She clearly understood the choice she was making. It was explained orally to her, and in writing, complete with examples and pictures, showing how she would be compensated is something was damaged. The other issue is in regards to the Headboard. She is asking for $300.00 compensation for what amounts to screwing 4 nuts onto 4 bolts. I can not give her $300.00 for this. I have offered to have someone attach it for her. She has not accepted that offer.
