Complaint: This complaint is in reference to the manager and loan officer and the Hilmar branch of F and M Bank. A few years ago I transferred my business account from Wells Fargo to Farmers and Merchants Bank. ****** ***** was my account rep and she had told me that if I brought my accounts over to F and M bank that they would give me a credit line of sorts of $70,000. I transferred my account over to them and I told them I was using the $70k to purchase some property. At this time they said we would use the property as collateral but not record anything on the title. It turned out that on a $70k loan without really telling me the loan rep also filed a UCC-1 against all my equipment and crops that I produced through farming. That alone is valued gross at $1.6 million or so. Fast forward some years I found out from another bank that there was a UCC-1 filing on my PPE and Crop. So I contacted F and M bank and they told me to speak with a **** *******. I left her a message and did not hear back until I called her two more times over a span of a week or so. When i finally got a hold of her, **** *******,(who works in the Hilmar branch), to discuss why the loan originator would have done such a thing.....told me that she understood where I was coming from and she would try to rectify the situation by taking the loan of the title of the house. I explained to her that one or the other should be removed because the loan value was not that big and that I was paying over $1,000 in flood insurance a year that was not necessary and it would help me out to get rid of it and keep the UCC-1 in place. I also told her in detail how the loan payments were being taken out of my bank account every month along with a principal reduction of $3,000 in September. After our initial conversation I could not reach her again off and on for weeks at a time. I was becoming frustrated and in regards to the flood insurance I was starting to speak with numerous people at the bank. I explained to the bank that **** had told me to hold off on paying for the flood insurance while we figured out a way to get the loan off of title. A while later she said she spoke to underwriters and for this loan she needed a lot of information. I told her it was wrong what the loan originator had done to me and I had never missed a payment in years and if she could speed up the process. Again she disappeared for sometime. After sometime again I emailed her and questioned what was happening. She sent me a list of things she needed, on such item was 2011 tax returns. I told her numerous times that my accountant is working on them and i needed time. She said it was fine as long as i sent her some other financial info. I sent that info to her and never heard from her again. IN the meantime her manger *** called me and told me that I needed flood insurance. I told him i was upset that so many people were calling and **** never answers my phone calls for weeks at a time. I also told him that **** had told me to hold off on the flood insurance. He said to me that he understood where I was coming from and that flood insurance was a waste of money. He told me he would deal with the problems and call me back...... that was 2-3 weeks ago and I still never heard from ***. In the meantime I got a letter stating that the Bank had placed a $3000 flood insurance premium in place and attached it to my loan. I was extremely upset and let a lady named **** ****** know it. I explained WHAT I WAS TOLD BY THE MANAGER AT THE HILMAR BRANCH AND **** and was **** off that the bank could treat me this way. SHE said she also understood, but could do nothing to help. I asked her if she had spoke to *** the manager and told her that *** said he would take care of this FLOOD insurance problem to me. **** told me *** spoke to her after he talked to me and told her to just do what she had to and place the $3,000 policy in place on my loan. I cant believe that people can lie to customers the way I have been lied to. They told me it would be easy to deal with a smaller bank. NOT TRUE!!!

Desired Settlement: I WANT RESULTS! I dont want to be lied to any longer! I want the people in the HILMAR branch to be reprimanded in some way shape or form. It is unfair to be treated in this fashion. I am upset and my money is being wasted.

Better Business Bureau 3705 Beacon Blvd West Sacramento, CA XXXXX Regarding BBB case number: XXXXXXXX Dear : We received your inquiry regarding Better Business Bureau case # XXXXXXXX. We have reviewed and investigated the situation and are concurrently issuing a letter directly to the consumer to resolve this issue, which addresses the following: * F&M was sorry to learn of the customer's complaint dated June 18, 2012 and his misinterpretation of the facts. * Collateral: o Borrower acknowledged, per loan documents executed April 28, 2010, Bank would have assignment of pledged collateral. * Collateral Release: o F&M requested additional financial information from borrower in order to consider release of collateral referenced in complaint. To date, Bank has still not received all required financial information. * Flood Insurance Requirement: o Federal law requires flood insurance be placed on this particular property type. o Borrower was notified of this requirement within the 45 day window prescribed by regulation. Though F&M sympathizes with borrower's position, the Bank had no choice but to place flood insurance until borrower obtained his own policy. o Borrower has subsequently purchased flood insurance policy and the Bank has cancelled the forced placed flood insurance policy.
