Complaint: I feel like the company is dishonest and lacks integrity. They ran a smog check knowing it would fail due to a "check engine" light. On September 14, 2012, I went to this location to get a smog test for my 2004 Kia Spectra. About a half hour before I was to get it checked, the check engine light came on. I didn't know that it would be an automatic fail. The smog tech ran it anyway and charged me sixty dollars. They said they could run a diagnostic test on the engine light for ninety dollars. The retest would be thirty dollars and a smog certificate for eight dollars if it passed. If the tech knew the car would not pass, why would he run it anyway? I was not very happy and let them know it. I paid my bill and left. The next day I talked to the manager and asked him why his company would run a test if they knew it would fail? I also asked him why I was being charged for a retest too? He said he would have given me a retest for free but he didn't like the way I acted the day before. I told him that I apologized to the lady in the office. Asking some other shops around town, they said most places will give you a free retest if your car happens to fail the first time.They also informed me that I could use two new belts. I feel this company is more worried about making a buck than to provide great customer service.

Desired Settlement: I just want my money back for their lack of integrity and to treat the customer fairly.

Business Response: Business' Initial Response
Mr. ****** was made aware of check engine light before the the smog was run. He said he knows about it and to run the test. Check engine light is only one item of several items on smog test. When he was notified he failed his test after the test he was very rude, calling names and using bad words to cashier and telling the customers in the waiting area we we crooks yelling and shouting.. Per state regulations we are to run complete test on all vehicles as they come. As a curtoursy, we let him know about the light before the test. We perform test as per regulations, there for no refund is due customer.

Consumer's Final Response
(The consumer indicated he/she DID NOT accept the response from the business.) The story is missing a few details. I told them my engine light had just turned on 30 minutes before going into the business. I never even talked to the smog tech prior to the test. True, I said some things that were not very professional but I later called the cashier and apologized. My position is still the fact that the smog tech did run the test knowing it would fail. The manager also forgot to mention that he would have given me a free retest after the fact but he didn't like my behavior. I have gotten a smog certificate from another business that asked the right questions. My next step is to picket the business if this is not resolved.Thank you.

11:20-Company called to state the consumer is in front of their shop picketing with signs that say 'Poor customer service, Being investigated by the BBB Consumer's beware'. Also stated the consumer has thrown papers at their cashier and made other slanderous comments. No refund will be issued to such a hostile, unreasonable person. BAR already closed their case as well stating we performed by the book, and did nothing wrong.
