Complaint: Roberts Auto Sales ran an unauthorized full credit report and history on a vehicle that I only wanted to test drive and had no intent on purchasing. Roberts Auto Sales on McHenry Ave in Modesto ran an unauthorized credit check and history on me on a white Chevy Malibu that I only intended to test drive at that time. His unauthorized credit check is illegal. After he told me had ran my credit I was furious! My friend and I went to leave and he handed me a contract and insisted in a pushy manner that I sign it or that he would get into "trouble". I told him "good" and my friend and I left. His credit check did appear on my report.

Desired Settlement: It should be investigated, his license on review if not suspension and it should be determined if this is his standard business of practice and he should be strongly warned of the consequence of this type of practice.

Business Response: Business' Initial Response
Company states that they are unable to respond to the complaint without additional information. They request to know the date of the inquiry and the name of the specific credit bureau.

Consumer's Final Response
(The consumer indicated he/she DID NOT accept the response from the business.) All the information came from them. They initiated it. Requested it and mailed it to me. For which I forwarded a copy to the DMV who issued their license. I can also mail a copy to the BBB as well. I have it. This is typical lack of acknowledgment, responsibility for wrong doing and ownership. I DO NOT ACCEPT THIS RESPONSE!

Business' Final Response
At Selena Santa Cruz's request, the Department of Motor Vehicles was sent to Roberts Auto Sales to review her complaint. The DMV determined it was not really feasible for Roberts Auto Sales to have ran Selena's credit without her first providing a social security number and other personal information for Roberts Auto Sales to use. DMV also recognized that Roberts Auto Sales has been in business for over 32 years, and in this time has had very few complaints, if any... We are sorry that Selena feels she has been inconvenienced by her experience at our dealership. The finance manager that assisted Selena has been with Roberts Auto Sales for over 13 years, and has sold well over a thousand cars while employed with us. Prior to Selena, we have not received any complaints about Casey's job performance from any of our customers. I have hundreds of letters complementing Casey on the wonderful experience that our customers received during their purchase at Roberts Auto Sales. Please refer to our previous letter that explains our position on Selena's experience at Roberts Auto Sales...

BBB's Final Determination: After reviewing the position of all parties, BBB determined that the business made a reasonable effort to address the complaint. However the consumer remains dissatisfied.
