Complaint: This Company dose not fallow threw, No work ethics, shady,unprofessional. They do not give straight answers,They are a help them selves. We have had problems from the first day With Comfort City, They got the down payment and then we did not see them for a long time. Work did not started as the paper work state. The crew that was assisted to do the work, did not showing up to complete the installation of heating and cooling unit. On more then a few occasions workers staying till late into the evening.There was an Improper installation of Unit, it sounded like a Jet plane was in my house and the house rattled as to come off its foundation, It took many visits to fix this problem, to no a-vale, My husband finally fixed the problem his self. My husband found the air intake lose. And the inspectors made Comfort City put more support to hold the unit on the roof, and added a few more support beams to stop the rattling of the unit. And they use my preexisting gas line that was for a fire place with out are permission, and are materials, with out are consent. Now we are paying out of pocket again for a new gas line. Also the owner Nathan, gave us lots of rebate papers from air ducking, to tax rebates, and a few others they were all fake, I showed him the letters from PG&E and H&R block tax preparers. Nathan took them and I never got them back and I didn't not get any of the rebates he promised. Witch added up to about 3000.00 $. The ac unit was damaged and needed repair from day one. I never received any paper work on what was fixed on the unit. Nathan has worked on the ac unit on more then a few occasions and and I don't get the paper work on it or even a work order of what was done. I have asked him for them still waiting for them. It took over 3 years for Comfort City to get a warranty manual to me. Its was given to me on July of 2012 and this was only after I bugged them because I had to pay out of pocket to repair the ac unit many times, It was strange that only after I got the warranty manual and the fan blade broke again that I was not charged a fee this time to fix the fan blade. My husband called Nathan out to the house and they discussed the problem of the broken fan blade. My husband dose construction work on building and suggested that the motor was out of balance, because this was the 2 time the fan blade was replaced, and Nathan had no reply to this statement. You ask me to show you paper work any dates but I have yet to get any from Comfort City. They are now billing me for 198.00$ they say because I kept the fan blade. The worker gave me the broken fan blade he said (they were going to throw it away) but he did want a picture of it to show his co workers. He had never seen a fan blade broke like this one before. He took a picture with his phone. He assured me that it was Ok for me to keep it, the young man even put it in the original box it came in for me, and then handed it to me. The fan blade broke in such a bad way that I thought my husband should see the damaged blade. The young man took his latter and left, he came knocking at my door again a few minutes later because he forgot a tool on the roof, he got it and left. Now Im got calls at home this summer of 2012 asking for the blade back, We were working out of state and tryied to call them but had lots of troble conecting with them, We came back into calif. on August 2012 and I had a few not so nicely worded calls on my answering maching fro Confort City, stating I would be billed for the blade, and When I did speack to the person at Comfort City she said I had to pay for the shipping of the blade, I told her sorry but I would not pay for their mistake and I would leave it out by the front door for them to pick it up at there time. She said NO! they would not send any of there worker out to pick it up, and why should it cost them to pick up the blade when I wanted it. I explain what happened and she do-sent care. I told her for Nathan to call me . I would stay in town to fix this problem I have yet to hear from them. I did send them a letter asking for a work order. nothing yet I'm wating!

Desired Settlement: For this Company to send me my work order for all the work done on my unit, for them to stop calling me and stop billing me for the fan blade. For them to leave us alone. I will not seek there services any longer.

Business Response: Business' Initial Response
The ******'s new out of the box system was installed to code, permitted, HERS tested & signed off by the City Of Lincoln. Several attempts to eliminate the vibrations of the unit were made to satisfy the ******'s. They had said they were OK with the final fix made & no further repairs were made for this issue. The system that was purchased qualified for tax credits & utility rebates. All paperwork showing the qualification for credits & rebates was given to the ******'s. It was explained to them that for the tax credit they would have to talk to a certified tax properer for we are not.The rebates were to be sent into the utility company. The responsibility was on them to follow through with each credit & rebate once paperwork was given to them. Equipment manuals were given to the ******'s upon unit install as is the case for all customers. The system has a parts only warranty and no labor warranty from the factory. For all repairs that we made parts are covered & labor is billed until warranty runs out. Upon completion of work technician invoices are given to the homeowner & they sign off. The last visit for the fan blade no invoice was given to owner because the tech that was sent out was new with the company & ran through all issued invoices for the day. The tech stated that Mrs. ****** said she needed to keep the fan blade to show her husband & the tech told her that he needed it for the warranty. The exchange went back and forth so the tech left the fan blade with her as to not cause any problems. In order for a part to be covered under warranty it must be exchanged. All factory warrantied parts require you to exchange your damaged part for their new part. This is the same process that we had done on the two prior warranty issues with the ******'s equipment.The ******'s were contacted the next day to return the part or get billed for it. Mrs. ****** declined to return the part. If the ******'s wanted to keep the part then they need to pay for the part just as we do prior to the exchange. Because Mrs. ****** requested the part they were billed for the part. A bill/invoice was sent out a few days later and the billing was sent back with a note asking to have ****** call them. Several calls were made and no response from the ******'s was made for 2 weeks. (At this point we are 30 days into the return time of the part and now the return period is over.) The ******'s left a message for ****** and a return call was made but no answer by the ******'s. Do to ******* schedule & minimal time in the office talks were transferred to ********. Mrs ****** called into the office asking to talk to ****** and ******** proceeded to help her. Mrs ****** told ******** that she is blind & her husband drives trucks & she has no phone, he will not leave the cell phone with her so they have no line of communication that is why they haven't called us back. Mrs. ****** said we could come and pick up the fan blade. We declined to send a tech out to her home to recover the fan blade for the warranty period was over. Another bill was sent out to pay the $198.00 for the cost of the parts and labor.

BBB's Final Determination: After reviewing the position of all parties, BBB determined that the business made a reasonable offer to resolve the complaint. However the consumer did not accept the offer.
