Complaint: While tree trimmed, large heavy limbs we're roped on house causing damage While trimming tree in sept 2012. Evergreen tree service of Stockton, ca dropping numerous heavy limbs on my house. Resulting in damage of rain gutters, roof and structure. Owner sent his tree trimmers to fix the gutters. No other problems were fixed. We have attempted to get owner Oscar ***** owner to come by to look at the work his employees did. Mr ***** has never attempted to come over. In the meantime I had my insurance adjuster come by to assess the problem. Where he found the fixing of the gutters laughable and found numerous roof and structural damage.

Desired Settlement: While having a tree trimmed in our backyard by Evergreen tree service of Stockton Ca .. Numerous large limbs were allowed to drop on our house, resulting in gutter, roof and structural damage. Mr. ***** had his tree trimmers come by and have the gutters replaced. We have placed numerous calls for Mr **** to come by to look at the shabby work done by his employees. He has returned our calls, yet never has come over. He has eluding the fact that there is a problem. Since then we had our insurance adjuster come by to check on claim I had filed. He saw the gutter situation as laughable, then went on the roof and in the attick, where he found multiply areas of damage done by heavy objects (tree limbs). He stated that our insurance does not cover faulty workmanship. So I'm left with a house that has miss matched gutters installed incorrectly on the house (gap of 3-4 inches).

Business Response: Business' Initial Response
In regards to Mrs. ****** statements, Evergreen Tree Service did perform work on a tree on their property. Our services were contracted out by ******'s mother in law while roping down a branch it brushed the gutter causing 3-5 feet of damage at the corner of the house. The gutter to Mrs. *********** house was rusty and old. There were places in the gutter that you cold poke your finger through as I was told by my employees. I spoke with Mr. ******** and ******, I asked Mr. ******** if I could come by at 10 am on a Saturday morning. He stated he was not going to be up. He is unemployed. During my conversation with ****** I asked her two questions. The first what is it that you desire for me to do? The second why was there approximately fifteen feet of gutter missing when only 3-5 feet of gutter was damaged? My employees told me that the first time they went to check the damage and get the necessary material to fix the gutter it was 3-5 feet but when the returned the second time a larger section was missing. ****** did not answer my questions. I did let her know the condition of her gutter as being rusted and old and that I would pay for the section of damage that we caused but I would not pay for the whole side of house to be replaced with new gutter there was no response.

Consumer's Final Response
(The consumer indicated he/she DID NOT accept the response from the business.) First of all lets get the record straight. My last name is ******** nor ********* Conveniently the owner of Evergreen Tree service has got his info wrong. I talked to Mr ***** once. That is when I spoke to him about the damage to the gutters and the damage to the south side eves and trim which can be easily seen. At that time he told me that his son-in-law was a contractor and he would be by before the first rainfall to fix the problem. Well that didn't happen. In fact when he finnaly sent someone, he sent his tree trimming men to fix a contractors job. We had left the gutters as they were when they were damaged. a 8-10 feet of gutter was damaged. As known, gutters come in pre-cut lenghts, so when the men took down the gutters, they cane down in sections. We still have the rements of said gutters here. After the job was done we called and asked Mr. ***** to come by and look at the unsatistfactory job that was done. The gutter was spliced into the old gutters and at the end of the house the gutter is not even affixed to the house, there is a 1-2 inch gap between the house and the gutter. The south side to the house was never fixed. During the whole time of the tree cutting Mr ***** was periodictly on the job site. he was elsewere tneding buisness. He did not see how many times his employees let branches fall on my house. We could hear the branches hit the house hard. Unaware of my husband standing next to him, Mr ***** looked at the gutters and said "I'm not going to fiix that". My husband stated "Yes you are". Mr ***** stated he would not fix that whole side of the house with new gutters. I dont cxll 10-15 feet of gutters the whole side of a 30 feet side being fixed. My husband told Mr ***** that he would be home anytime, at times he does work workside. He in not unemployed. The whoe subject of this matter is fixing areas of faulty work. Mr ***** stated he would send a contractor to fix the job and he sent his tree trimmers to fix a house, then he didnt even fix everything. I had my house insurance come and evaluate the problem, they inspected the attic to find multiple places when every heavy items hit the roof. stateing the my insurance would not fix a problem brought on by faulty workmanship. I well not be satisfied until my house is fixed. The fixing of the gutters is laughable, the rest of the damaged roof is intolerable. i am soo dissatisfied with Evergree Tree Service that I would never reqimend their service to anyone. I should have read the comments on the BBB web site first and mostly read the fact about his company on the state licence board most of all. Thats were the truth is told.

Business' Final Response
First, I never stated that I would not fix the gutter. Second, the noise that they heard were men on the roof, and yes tree branches. The tree that was trimmed was near the house, and branches were extending over the house. The only place those branches could be set down were on the roof. Those branches were roped down. Third, I never knew of any damage to the roof or any insurance agent inspecting it until I received a letter. Finally, I know that damage was done. Not only did I speak to ******, I spoke to her husband. I would like to get this matter solved. I know that I am responsible, but also I do not feel that I should pay for a new gutter on my own. The gutter that was damaged was already rusty and old. They, also, should be held accountable.

BBB's Final Determination: After reviewing the position of all parties, BBB determined that the business made a reasonable effort to address the complaint. However the consumer remains dissatisfied.
