Complaint: The contractor is not performing according to our contract. We signed a contract on Jan 26, 2014 for a sunroom addition. There were some understandable delays in obtaining permits but the permits were obtained several weeks ago and substantial work has not begun on the project. I was told there was a death in the extended family. Then I was told there was a delay in obtaining concrete. Then I was told the sunroom was not built yet. The contractor today told me he was depressed and wanted to leave the country because he does not like the USA anymore. He also called on my answering device and offered a full refund. When I asked him to go ahead and refund the money , the then said he could not and he would go bankrupt. He offered to meet again over the weekend, but could not resolve this issue over the phone. I have paid $12,000 and do not have the sunroom and only an area that was dug out for concrete and a moved water faucet. I asked for a discount due to the delays and he said he could not offer that to me over the phone. The contractor's cell phone has not been working for 2 weeks, he said it was stolen.

Desired Settlement: The contractor offered a full refund and I wish to accept that offer. Clearly he is not reliable in performing the work. I have a voice recording of his call on my answering device offering the refund.

Consumer Response: Consumer states an agreement was reached and contract is in the process of being fulfilled.

BBB's Final Determination: Consumer accepted resolution offered by the business.
