Complaint: According to contract, Verde Creations would schedule a 90 day visit and replace all plants that died. They have failed to replace the plants. Our contract stated that Verde Creations would schedule a 90 day visit where all plants that had died would be replaced. After at least a month, and no contact from the vendor after the 90 day mark, myself and my husband sent several emails letting Verde Creations owner, ****** ******, know that we had several plants that had died that needed to be replaced. It took a very long time to get a response from him, and he asked when he could come out. We gave him a time which didn't work with his schedule, which we understand, but he never contacted us to tell us that the time didn't work, nor try to schedule another appointment with us. At that point, I sent another email, and he asked me to take pictures of all of the dead plants and email them to him. I did as such, but never was told when he would send someone to replace the plants. I sent another email at that point (several weeks ago), stating that we had maintained our end of the contract (paying the full amount due, and in a timely fashion), yet he had not maintained his portion of the contract (replacing all dead plants at the 90 day mark after project completion.) I informed him that if his company did not come and replace the plants that we would have to take outside partners to help us get the contract fulfilled. He had someone out that day to replace some of the plants and pulled the remainder of the dead plants. The man that came to replace the plants said that ****** would be in contact with us to let us know when he would bring the rest of the replacement plants to put in our backyard. I received an email from him on a Sunday 2 days later letting me know he had limited wireless service on a project he was working on in Rocklin, and that is why it took him so long to get back to us. I responded to that email on 9-15-12, asking him when he would be replacing the plants, and have yet to hear from him.

Desired Settlement: We would like the remainder of the dead plants replaced with new plants.

We have had one of the hottest summers in the rescent past. We replace plant material at 90 days because plants are just starting to get established and if there is an issue with the plant material, it will show up in this time frame. Planting with established plant material was complicated this summer due to the extreme heat. New plant material needs a lot more water than newley established or established plant material. This was explained to Matt when I visited the house on one of the several courtesy checks after the project was complete. Based on most people's busy lifestyles we have found planting in cooler temperatures much more successful. This is what we did. I just got this complaint today in the mail but we were scheduled to plant the material this week. All of the dead or dying plant material was replaced. Overall we chose to delay the re-planting with the customers best interest in mind. We could have easily replaced the plant material at the end of the 90 day period regardless of the weather conditions, but based on my conversation with Matt I thought we were going to try to time it for more ideal planting conditions. We regret that this homeowner is upset with how this final detail ended as they were very pleased with the final outcome of landscape space. We strive for excellence in all we do and hope they are pleased with the plant material we replaced for them.

BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
