Complaint: I took my 2004 Nissan Altima to Precision Auto Care to tell me why my care had the "service engine soon" light on. While the care was in their hands the transmission broke

Contact Name and Title: Michael ****** (owner) Contact Phone: XXX XXX XXXX Contact Email: ***** On 1/18/2013 Mr. ****** brought his 2004 Nissan Altima in for a check engine lamp diagnostic. My technician diagnosed the problem as a leaking cylinder head gasket casing a misfire code to be set. As he backed out of his stall and went to move the vehicle forward the transmission failed. We cannot assume responsibility for this event. There was no way the technician could know this would happen. Please read the bottom paragraph of the work order the customer signed. Consumer's Final Response
I do not accept the company's response. I was not there when the transmission blew, and was only told by one of the mechanics that there was a loud boom. I understand that they are mentioning that this could have happened at any time, it just seems unrealistic that the moment the car got touched by a mechanic the transmission went bad. They are clearly responsible for their mistake. The $89.00 they want to refund back is a joke. The cost to fix their mistake is going to cost me more than $3000, which I should not be responsible for. Now the car is sitting at home, and I have no transportation to get to and from school. The waiver that I signed mentioned that the company was not responsible for lost or stolen items while in their care. Regardless, they are responsible!!!

Precision Auto Care in no way had anything to do with the transmission failing. This would have occurred with whoever was driving the vehicle. In addition you signed a waiver when you signed the repair order that says we are not responsible for consequential damages while in our care. I will however refund your diagnostic fee as a jester of good faith. ****** ******
