Complaint: **** promised a 90-day warranty. It was not effective until 2 months after sale, then was expired because mileage on the bill of sale was incorrect. Vin 4S3bh6653yXXXXXXX. Sales Agent was ****. Bill of Sale on 2000 Subaru Outback dated 8/19/12, with 90 day warranty promised verbally by ****. There was no mention of a 4,500 miles limit for the warranty. The mileage listed on the Bill of Sale was 118,596, although the buyer, ****** ********** remembers that the mileage was almost 120,000. 12 days after sale, on 8/31/12 the head gaskets went out. The mileage on the *** **** receipt on that date was 120,399(1,803 more than on Bill of Sale.) Auto Max kept the car for three weeks until 9/21/12, buyer paid $800 for the repair because the warranty was not turned on. 20 days later on 10/13/12 the transmission went out. On 10/19/12. at buyer's insistence, **** turned on the warranty with GWC. However, the warranty was not honored at that point because the the mileage was 864 miles over the mileage limit. It was 123,960 at the Auto Doctor on 10/13/12. Google maps lists the distance form the dealer to the drivers home at XXXXX ******** ***** ******** CA as 85.1 miles. Even with the three trips required by the diver to go back to the dealer, it is not possible that she put 5,364 miles on the car in the 22 days that she drove it. Those trips put 510.6 miles on the car. For part of the time that the driver did have the car, she lived in Reno and worked in Truckee. Even if she had driven 60 miles round trip from Reno to Truckee (which did not) she would have put on only 1,320 miles for her commute in the 22 days that she had the car. A reasonable estimate of mileage put on the car is 1830.6, not 5364. If the mileage listed on the bill of sale was accurate, she would have been within the warranty at the 10/19/12 claim.

Desired Settlement: I am seeking that the dealer correct the starting mileage on the bill of sale to 120,000 so that the warranty may be properly applied. Also I am seeking reimbursement for the $800 head gasket repair which should have been covered by the warranty, 100 for the diagnostic on the transmission repair, and for $600 for the loss of use of the car for three weeks. Alternatively, the dealer can refund the purchase.

****** *********, bought a 2000 Subura outback from automax on 08/19/2012, with odometer reading, of 118,596, based on customer information, customer took the car on 10/13/2012 to the auto doctor for transmission service, auto doctor stated that the mileages was 123960, which makes difference on the mileages of 5363, Gwc warranty, 3 months 3000 Miles which comes first, customer over driven over 3000 miles restriction on warranty ,warranty not valid due to the over mileages.
