Complaint: The chimney company installed a new liner which was too large for the space behind the bricks in the wall. The contracts list the price of the liner as $1500 and the balance of the $4,700 total to be the work on the brick wall. The owner (****) stated that the only difference between the condition of the wall from before they started the work would be that they would not be replacing the sheet rock wall. The brick wall would be exposed. I was ok with this and would was planning to leave the exposed brick wall. I gave him a $500 cash deposit on 10/**/13 which was the day the owner had come to look at the chimney and the connection go the boiler. On the first day of the work (10/**/13), the workers opened up the sheetrock wall and the brick wall behind it. On the second day, the workers arrived with a liner and installed it. **** stopped in to check on the workers and was overheard telling the workers to push it back as far as possible. The workers were overheard telling the owner the liner was as far back as it could go. **** requested to collect the balance of the work so I gave him the balance in cash. After he accepted the money, he told me that they were getting ready to close up the roof and he could not complete the brick work because the new liner was larger than the old liner and stuck out further. I did not ask for a larger liner. I feel the reason for this miscalculation is on the owner's part. I was shocked that they were planning to leave me with a now exposed liner with half a brick wall and broken sheet rock wall - in other words a mess. I have photos that I am happy to supply. The owner explained that it would not be possible for him to put the brick wall back as had been the plan because liner was too large. This was unacceptable to me and I told him if he could not complete the work I wanted my money back. I expected a closed brick wall especially for the enormous amount of money he was charging for the work. Now he was not doing the same work he had originally promised and was not offering to refund me for the work he did not complete. Because of this, I feel I should only be responsible for the liner which was $1500. There must be a way to close up the brick wall but he did not seem to know how and did not want to attempt it. After telling him I could not accept the open wall he asked if I wanted it closed with sheet rock. I said I would. He suggested I find someone on my own. I told him he needs to get someone to close up the wall after all I paid him. He said he would be responsible for the sheetrocking of the wall and marked my contract as such. He sent an elderly man to see the space later the same day. The man said it would take him many days to do the work and that I was to pay him. At this point I am disgusted with this situation and would like **** to refund me for the work his company did not complete.

Desired Settlement: I would like a refund of the brick work that was not completed. I feel I should only be responsible for the $1500 liner that was installed - although it is too large - and the rest should be refunded back to me.

On 10/**/13, B&P Chimney Company was at ***** ** ***** ********* ** to clean the heating system chimney at the price of $39.95. An employee went up on the roof to brush the chimney from the top downward. The brush would not go through the length of the chimney. It stopped about 10 to 12 feet down. The boss, ****, went down to the furnace room to try and see into the smoke pipes and noticed that it was only a 4 square inch cavity. **** then went up onto the roof to find that the chimney was made of old brick and without terracotta clay fireproofing. After looking inside, **** found a brick obstruction within the chimney. Bricks were falling into the cavity.
**** and his employees showed the woman the bottom of the chimney and explained what she needed to have done. **** told her the old brick chimney would have to come down to the basement through the roof and house in order to make room for a metal-bestos type B vent chimney for gas appliances. Her furnace was 6 inches in diameter and her hot water heater pipe was 4 inches. In ****’s experience, she needed a 6 inch lining for proper ventilation. The price totaled $5,500 and she agreed to it, giving **** a $500 deposit and setting a date to start the work.
Later that evening, on October **, 2013, she called B&P Chimney’s answering service and wanted to talk about the price because she thought it was too high. **** caller her back and told her the best offer he could give her was $5,000. He also told her that if she wanted to call another company she should do so. She offered to pay $4700 and **** again told her to call another company. She replied “I trust you, and if I call another company there is a chance there might be black people in my house.” **** agreed to do the job at $4700 with her $500 deposit, leaving a balance of $4,200.
On October **,2013 B&P Chimney employees showed up to the job site and took the chimney down through the roof about 6 to 8 feet to find the brick chimney was built alongside a brick wall in the house, which the owner did not know existed. They also found that the 4 inch cavity went down on an offset angle. The woman started getting upset, not realizing that this wall was the actual chimney and that it had to come down in order to put the lining in. She started doubting the employees, asking them to stop and fix the wall. That’s where the miscommunication started. B&P Chimney thought the wall she wanted to fix was the sheet rock, not the brick wall. You cannot take all of the bricks out of the way and reconstruct a wall of brick without a footing of concrete as the support.
Earlier in the second day of construction, she called **** to tell him that she only wanted him to be the one to collect the balance for the job. He informed her that he only time he could come to the house would be around 1:00 pm. After she paid the balance of $4200 to ****, she said she wanted the workers to brick back up the wall. **** told her that would be very unsafe because there was no support behind it, but she continued to get upset and complain about the money. The homeowners’ daughter happened to be at the house at this time and **** explained the situation to her. The daughter understood what needed to be done. The daughter requested $500 back to fix the problem with the wall. **** agreed and gave them the money. The homeowner was still not satisfied and insisted that **** call someone to fix the sheet rock wall. **** then contacted *** *******, an experienced sheet rocker and taper for forty years, to access the situation.
Upon contacting *** *******, he arrived at the house within the hour and assessed the job to cost $475. Both B&P Chimney and the homeowner agreed to finish the chimney the next day and that *** ******* would arrive at 11:00 am to fix the wall. However the following day, after B&P Chimney had confirmed the job at 11:00 am, no one would answer the door when *** ******* arrived at the house. *** ******* contacted B&P Chimney’s office and informed them that no one was answering the door. After waiting an hour *** ******* called again saying there was still no answer at the door. At that point the office advised him to leave. *** ******* had everything he needed with him to fix the wall, if only the homeowner would allow him in the house. *** ******* is very experienced and has done work at ****’s home as well as at his partner’s home. She made several comments to **** about people of color and we at B&P Chimney are reluctant to work for these people, but she insisted. B&P Chimney completed the job that was contracted, and provided the customer with an experienced sheet rocker to replace the brick wall with sheet rock as discussed and refunded her $500 to cover the cost of that repair, which was given to the daughter.

Business Response:

WE ARE WILLING TO REFUND A TOTAL OF $1500 TO THE CUSTOMER -*** **** FOR HER TO BE ABLE TO HIRE SOMEONE TO REPLACE BRICKWALL(CHIMNEY) IN BASEMENT.  THE WORK DONE BY US, IS WORKING PROPERLY AND THE REMOVAL OF THE CHIMNEY THROUGHOUT THE HOME AND SEALING THE ROOF AND REMOVAL OF ALL DEBRIS HAS BEEN COMPLETED. THE ORIGINAL PRICE OF $4700 WAS DISCOUNTED BY $500 WHICH WAS GIVEN TO HER AND HER DAUGHTER ON 10/**/13. HER TOTAL COST WAS 4200.  WE ARE WILLING TO REFUND $1500 FOR THE COST TO REPLACE THE WALL.  WE WILL NEED A SIGNED LETTER STATING THAT SHE AGREES WITH THE PRICE.  WE WILL STILL HONOR HER 20 YEAR GUARANTEE ON THE INSTALL OF THE STAINLESS STEEL LINER.

Complaint: I had called company to clean my chimney and furnace that goes out to the chimney, the guy vacuum the pipe from the hot water but did not clean the boiler pipe, I simply asked him to clean it he refused, he had already taken dirt out from the roof of the chimney and placed them in a bucket.. I told him he needs to clean the pipe from the boiler to the chimney, So i said to him until thats done and he cant get paid his $40.00. sadly he dumpedd the dirt back in the chimney on the roof. I had to call the police and made a report.

Business Response: the smoke pipes to boiler were extremely rusted and unable to remove them.
