Complaint: On 5/**/13 at approximately 10 pm A & G Auto Repair tow truck showed up to pick up my car, which was involved in an accident. The car was up on the grass against an electric junction box. The tow operator backed his truck up to the curb, slid the flatbed under my rear tires, hooked up the chains to my rear axle and pulled the car, which rolled effortlessly onto his flatbed. He would not give me a receipt on site, only gave me his business card and told me the car would be in his yard. When I called on Monday 5/**/13 to inquire about taking it to a body shop and how much the tow charges were I was told it would be a total of $621.72. The owner named **, was very rude and yelled at me over the phone and later at my wife in person when we tried to tell him there was a mistake with the charges. His driver added charges for $275 just for showing up and taking the car 8 miles to their shop. Then another $150 for Winching and Recovery, $25 for fuel surcharge, and $50 for cleanup. He performed no clean up and there was no Winching performed as I was there watching him; and fuel surcharge to go 8 miles is outrageous. The driver told his boss the car was in a ditch, which it was not, and my wife offered to show pictures to the owner but he refused, became loud and offensive and told her to pay up or he would keep the car and charge us $65 more per day for every day he kept it on his property. We were forced to pay and be quiet.

Desired Settlement: I would like an apology for my wife from the owner, a billing adjustment from $275 to a reasonable fee to pick up my car and take it only 8 miles away on Sunday night (when he charged us only $75 dollars on Monday to take it to the body shop 5.6 miles away), a removal from the bill and a credit back to our card of the bogus charges of $150 for Winching and recovery, $25 for fuel surcharge and$50 for cleanup.

As per our conversation on May **, 2013, I am writing you to explain what transpired from May **, 2013 to the present time.

On Sunday May **, 2013 my business, A&G Community Auto Repair, received a phone call at  approximately  10:00 pm from the East Fishkill Police Department for an auto accident.  My driver responded to the accident and when he  arrived he found a 2006 Volvo that drove off the road, over a residents front yard,  over the top of an electrical box and a concrete pad, and into some trees that stopped the vehicle.  My driver assessed the accident scene to determine the best way to pull the car out and remove it without further damaging the car or the residents property.  He than backed the flatbed up towards the rear of the car and hooked the  cables up to the provided tow hooks on the vehicle and NOT the rear axle as the customer stated.  My driver  then winched and pulled the car off the trees, off the electrical box and the concrete pad that the vehicle was stuck on because the vehicle could not be driven off the concrete pad.  He then winched the car onto the flatbed
for transport.  After lifting the car my driver had to remove a part of the electrical box that was stuck under the
under carriage of the vehicle. This is all part of cleanup as a result of the accident. My driver cleaned up the resident's yard and woods of any car and electrical box debris.  *** ******* stated in his complaint that he was denied a receipt from my driver at the scene of the accident and only received a business card. The final bill is not written on the scene of an accident and no money was exchanged at the accident. *** ******* wanted the vehicle towed to ******* **** ****** on ***** ** in Fishkill, New York, but my driver explained to the customer that ******* **** ****** was closed at this time. Since it was 10:00 pm there would have not been anyone at ******* **** ****** to pay towing charges so the car would be bought back to A&G Community Auto Repair. The customer was told the following morning he could contact ******* **** ****** to make arrangements for the vehicle to be picked up or delivered to ******* **** ******. Ifthe customer would have called *****'s the bill would have been paid in full. *** ******* called my shop the morning of Monday,  May **** and got loud on the phone with my business partner, ** **********, regarding the price. ** also  raised his voice at the customer and told him the bill would need to be paid before the car would be released to anyone. ** tried to explain to *** ******* that ******* **** ****** would have paid for all the charges if the car was bought to his shop, but the customer was extremely angry and would not listen. *** *******'s wife came down to pay the towing charges and was extremely rude and loud to my staff in the office and in front of two of my customers. ** tried to explain to her that she did not have to pay the charges, ***** Auto Outlet would cover them, but she rudely and loudly yelled at my staff that she did not want or need our opinion. Once again ** tried to explain she did not need to pay now  but she insisted and paid us and had us transport the car to *****'s.

When I received the letter from B.B.B. on Tuesday,  May ****, my driver and I  went to the accident scene to access everything and found that my driver did everything correctly and the customer was not over charged.  I  then contacted *****, the owner of ******* **** ******,  later in the day to discuss the
charges.  ***** told me the charges were in perfect order but honestly thought they were a bit low.  He would have paid the tow bill with no problems at all. ***** would confirm our conversation we had in writing if needed.  ***** also told me that the car was hit so hard that it was a total loss, it could not be repaired, and the insurance company would be reimbursing the customer 100% of the tow charges because *** ******* had collision on the vehicle.

I contacted *** ******* on Thursday, May **** at 12:29 pm to discuss the situation.  He was very blunt and to the point and explained to me that he was on the phone with Sears and I asked him to please contact me and he replied that he would call me back when he was off the phone with Sears.  I proceeded to give him my cell phone number so he could contact me directly.  As to this date, I have not received a phone call.

My towing charges are very reasonable and have never been challenged by the insurance companies that normally pay the bill.  He is also requesting $400 to be paid to him from A&G Community Auto Repair for towing charges that he will be getting reimbursed from through his insurance company.  When I spoke to ***** on May **** the car was no longer at his shop.  The policy is that insurance companies issues the customers a check for the vehicle and towing charges, and gets a release from the customer before picking up the vehicle.  In other words,  the customer would have already been reimbursed for the car and tow charges.

I have read in the letter that his wife would like an apology but I am not sure why since my staff was not rude or unprofessional to her at all.  I can get written statements from the 2 customers that were in my waiting room that heard the conversation and disagree with **** ******* statements.  If anything, she should be coming down to apologize to my staff and my customers for her loudness mid rudeness.

As stated above, I can get a letters from the owner of ******* **** ****** confirming our conversation and my 2 customer that witnessed the scene **** ******* made in the shop.

I have been in business in ******** ***, ** for 25 years and have never received a complaint regarding my towing company.
