The City of Carlsbad has violated NM Statute 30-13-2, which states that anyone denying the service of a utility to someone who lives in their service area, for any reason other than they owe the utility money for prior service, is guilty of a ***** misdemeanor. I would like to add that they are also violating that person's rights. Having access to water is a human right. I paid the past due balance on my account,plus a late fee, and a reconnection of services fee. The City has red tagged my house for not having water, which they say means my house is unsafe for human occupancy. They have therefore banned me from entering my house for any reason, day or night, under threat of arrest. They absolutely don't care that this makes me basically homeless, or that my cats are in the house and need food and water. They say I must consent to a home inspection before they will remove the red tag and restore water service. I don't know why they want inside my house so badly, but they are not entitled to go in, and they have no right to insist on inspecting anything in my house. There is nothing about the exterior of the house to give them reasonable suspicion that there is anything in the house that needs to be inspected. They are trying to force me to consent, by holding my water service hostage, because they know they have no legal right to go into my house for any reason.This is coming from Code Enforcement, the Director of Utilities, the head of Planning and the deputy City Administrator. They are all in on this violation of my rights. I have given them plenty of chances to retract their demand, but they are so certain that I am powerless to do anything to stop them, that they are insisting on staying this course. I am going to begin looking for an attorney tomorrow, to *** them for the violation of my rights, and for the damages at my home that I have suffered from thieves and vandals.
