            Newark, May 20, 2022 - Open Road Auto Group, which operates 15 locations around New Jersey, agreed to a $300,000 settlement to resolve Division of Consumer Affairs investigation into allegations that included failing to disclose prior accident history, using deceptive advertising and failing to honor vehicle warranties. The company voluntarily cooperated with the investigation and have agreed to enter into this  Assurance of Voluntary Compliance without having admitted any fact or violations of law.

            My name is *******************************; on 11/20/2021, I returned my Mercedes C class to Open Road Bridgewater by request. They were low on stock, and I received several letters and emails requesting I return my car early and that they would pay the balance due and the restocking fee. As it turns out, the car was not registered as a return with Mercedes financial until several days later. In the meantime, my auto payment of $465 was deducted from my bank account. Essentially, I paid for a car I no longer had in my possession. I contacted Mercedes Financial to explain what happened, and they provided proof that the car did not post until days after I returned the car to the dealership, for which I shared a copy with the manager. Mercedes did not tell me I should stop payment, and I didn't want the blemish on my credit by showing a late payment. Mercedes Financial disclosed that the dealership owes me the settlement.Additionally, a representative from MF called the dealership and tried to speak with the manager as I waited on the call. He never came to the phone; it was always the same story, not available, or he call will you back. At this point, nine months of attempts to resolve this is too much. Phone calls are re-routed, the manager never answers, and I leave yet another voicemail. More run around when I visited the business, the manager claimed he would resolve it for me, weeks went by nothing! Finally, I had to call him and, of course, no resolution. PLEASE REFUND MY $465 OR PROVIDE ME WITH A CAR FOR 30 DAYS!!

            My husband and I bought a used vehicle from this establishment November, 2022. We also purchased an extended warranty for a few thousand dollars and it was immediately charged to our credit card. We never received a copy of that warranty, even after several request. The extended warranty becomes active November, 2023.We decided to cancel the extended warranty and notified the finance officer who sold it to us. It took several text and phone calls to our salesman to obtain the finance officer's' ******* info.In December, 2022 via email, it was expressed that they cannot issue a refund to our credit card. The refund will be applied to our bank loan. It would ***********-8 weeks. We had no choice but to accept this method of refund.We are now into our 12th week and no refund. We are still paying interest on this amount. We have been emailing and calling with no positive update.We should not have been pressured to purchase this warranty.
