Obtained cargo ins. Exclusions are SO exhaustive it is tantamount to not having insurance at all. Virtually no scenario they cannot deny your claim!
I'm an owner/operator of small transport co. Mandated to have cargo insurance. Insurance coverage provided by BH contains so many exclusions that are so exhaustive in what they won't cover, that there is literally no scenario which they cannot find an angle to deny your claim. They're cargo coverage is nothing more than catastrophic, highly improbable, weather related occurrences. For example: they WON'T cover "...scratching, marring or shifting...of cargo"! They WILL cover a lighting strike-how would you substantiate a lightning strike??? The exclusions to coverage leave you without coverage-PERIOD! This is the worst insurance company on earth. They leave you completely & utterly exposed to every sort of risk & situation that can happen. They are so huge & so well funded that there is no way to negotiate or fight back. They take your premium & completely throw you under the bus. DO NOT use this company. They are a fraud! They tuck the exclusions to coverage way back in the packet of information. Had I known that I was, for all practical purposes, uncovered, I would have gone elsewhere to a real insurance company. Absolutely unconscionable business practice. Almost anything & everything that could go wrong with cargo is uncovered & they know it. They can even twist language to deny weather related situations. Mine was caused by rain that caused my securing of the cars to become displaced. Had it not rained, the measures I took would have been completely reasonable, appropriate & safe. The rain/weather, caused the problem & they denied it anyway, taking the position that it was my mishandling & poor loading that caused the damage. Do not be fooled. Any reasonable person would have the exact same reaction to this situation. I don't know how they stay in business with these sort of business practices. No wonder ************* is a billionaire-FRAUDULENT SCAMMER!!!

Desired Settlement
I want BH to revisit my claim. Look at the weather reports for the **, ** area for the day of the incident & acknowledge that I obtained cargo insurance for exactly this sort of situation & pay my claim. I'm a small business owner. Had I known I was uncovered, I would have sought out real insurance, not a horribly inferior product. Their exclusions make it clear that they pretty much ONLY cover weather related scenarios-that's what this was. It was NOT my poor handling or loading. It was safe & secure until the rain caused the displacement of the set-up. Using BH's criteria, they can even deny most weather related situations . For example: it may have flooded, but had the carrier put it in a submarine, it would have been protected! or, yes, the lightning struck it, but had the carrier put it in a steel/concrete package, it would have not been torched! or, yes, the tornado blew it away, but had the carrier taken nothing but tunnels on clear, sunny days, the item wouldn't have been exposed to the tornado!!! Ridiculous? Not so much in my case. This claim should be paid, period.

Dear Mr. *******:

In conjunction with the above claim, on ************ we received the "Consumer's Original Complaint" and "Consumer's Desired Resolution" as stated in the ************ Better Business Bureau letter. This was referred to me for response, which is set forth below.

Pursuant to your application, Berkshire Hathaway Homestate Insurance Company (BHHIC) issued a policy of insurance to you effective ***************** to *****************. Included in the policy forms was "Cargo Coverage Form Broad Form," form "M4427a (04 2008)."

BHHIC on ************* received from you notice of a loss reported to have occurred on **************. You reported that you transported a ************************ and a ******************** from ***********, ******** to ********, ********, after which damage to the ************ was discovered from the trailer ramp having "dug into" its tail fin(s).

The claim was assigned to a Claim Specialist, who engaged *************************** of ********, ********, and **** of ******** to assist in completing the investigation into the reported loss. When the claimant, ******* ********, was contacted, he reported that the ******************** was damaged as well, apparently from rubbing against the ************ during transit. ********************* contacted you to determine facts related to the loss, including obtaining photographs of the vehicles involved. ********************* also contacted the claimant, ******* ********. **** of ******** inspected and completed estimates of damage to both vehicles.

Investigation indicated that you folded the trailer ramp against the rear of the ************************ and placed blanketed boards between the ramp and the vehicle. At some point during transit, the board and blanket came loose, allowing the trailer ramp and its "jaw shaped teeth" to contact the vehicle directly and damage it.

The Cargo Coverage Form Broad Form contained in your insurance policy grants coverage for:

"(ii) your legal liability as a motor carrier or bailee for physical 'loss' to 'cargo' owned by
others."

This form also contains exclusions, including the following exclusion:

"This insurance does not apply to any of the following:

11. 'Loss" caused by:
a. shifting of a load in or on an 'auto';
b. leakage, breaking, marring or scratching, rough handling, or poor packing;

unless caused directly by fire, lightning and explosions, collision, overturning of the
'auto,' floods, windstorm, or theft."


After completing its investigation, BHHIC informed you by letter of ************ that the policy issued to you does not apply to this loss. Specifically, you were informed that the loss resulted from poor packing and/or shifting of the load, both of which are excluded by the policy.
A basic principle of insurance is protection against risks that cannot be avoided by reasonable conduct. Investigation shows that boards you chose to prevent this damage were not secured adequately. You could have prevented damage by employing other reasonable methods of loading and securing the vehicles and ramp. Further, the event of rain en route was not fortuitous. You should reasonably have expected rain or snow traveling from ******** to ******** in February.

In summary, we have found no evidence to support the Complaint filed with the Better Business Bureau. Instead, we believe that the investigation and resolution of this claim was consistent with the contract of insurance and compliant with state mandates.
