      On July 27th, my almost $600 oceanic kayak was destroyed by a working crew that was hired to do work at my complex. My property management company advised me on *** 31st of July that ***y finally made contact with *** owner, and were working with him to receive *** who/what/when of *** company that was here to go through ***ir insurance. I was also advised that if Im *** next few days ***y hadnt heard anything, ***y would just pay me out of his account. I have still received not even a single piece of news as to *** status of this problem. On Friday *** 11th of august i stopped into *** office to speak with my property managers, who were both miraculously out of office. Their front desk advised that I would be able to follow up via phone call on *** following Monday(august 14th) I called at aprx 11:30am and was met with a phone recording our offices are currently closed. So I try and call back this morning, *** 15th, and both women are out of office at a training event. At a training event, even though ** being assured Ill be able to follow up with ***m. Theyve been unresponsive, antagonistic, and negligent through out this entire pay out process, and cant even follow through with quotes time expectations.

      HOA I OWN my home. They find additional charges every month disregarding the fact that you are always a timely payer. They billed me and 39 other units $59 a month (354.00 each) from February to July of 2023 plus late charges for work that was not performed until June 29, 2023. They billed me $75.00 for keeping my waste can neatly in front of my garage. I am an older lady, I have breathing problems and severe allergies. They expected me to pull the can down the hill, around the building and back up the hill, in mud (which was the drainage work finally done in June 2023) after learning that I had been bitten by a snake back there in 2022. The area repaired for a total of $14,160.00 is still muddy but better. However, the drain Pipes (Hpvc) are exposed to mowers and foot traffic. There is still mud to contend with. No grass or landscaping. Today, when paying HOA dues, my account shows an additional $295.00. I am definitely accusing them of misappropriation. I believe this company needs to be audited and funds returned to the residents. I believe the management could be extorting funds. HOA does not allow residents to attend meetings. Ever. They claim they send emails making the meetings known. None of my neighbors have ever seen such notifications. There are zero accounting documents available to residents. We owners are not allowed to know who is on the “board”. We are not allowed to vote on members. I was told that only members with multiple units are allowed on the board of 3 people. Many many lies. This only scratches the surface. In 2022 all 40 units were charged over $300 each for gutter guards. Later that year in a phone conversation the manager accidentally divulged that the developer paid for the gutter guards.???? Hello!!! This company is so big in this county that no attorney will bother with them. They, at the very least, need to audit their employees. YES. I EXPECT RETALIATION TO THE COMPLAINT!

      Greetings ******,

      We appreciate you reaching out and sharing your feedback on your experience living within an HOA managed by our team. You and 39 other members are part of a townhome association. You own the unit within the building you live in and collectively own all of the property outside of your unit. With that being said the association is responsible for the upkeep of each building, and maintenance of the grounds. You pay a monthly assessment to tackle the standard expenses, and will from time to time pay special assessments for projects within the community. Specifics rules and regulations on your community are shared in the HOA portal which you have access to. There are four board members who currently serve your community. Your board of directors makes decisions for the community as a group. Byers & Harvey takes direction from the board for the day to day management of the HOA. You had mentioned that you are unable to receive emails or communication, but unfortunately you have marked all of our emailed communications as spam. I have an attachment that I have shared here that shows each email is sent back as spam for the past year, I also have a snapshot of the annual summary letter that we sent out to each of the homeowners explaining what the assessment was for and why there was an increase on fees. This is all decided by the board going into each year. Invoices are shared on the portal that you have access to for transparency. Lastly you mentioned a fee for a trash can. The board at the beginning of the year let all community members know via email that all trash cans needed to be stored in either the garage or behind the unit. Everyone was given at minimum a 30 day notice for this. Unfortunately at this time you were vocal about not storing your can or moving it, which is why we reverted to our violation and dues collection policy ( this is also shared in the portal ). Lastly I just wanted to remind you that Byers & Harvey takes their direction from the board of directors, any concerns or suggestions are always shared to them to allow them to make informed decisions in the future.       At the time of this complaint and still today, my account register shows $295.00 past due. On 01-02-2024 at 8:30am I received a response to my request to audit the account. (I do not find where I can attach proof to this response) The email stated; Good morning ******* I hope that you had an awesome new years celebration. Hey I got your request to review your account ledger, it looks like back when we started the special assessment you were only making payments for the dues and not towards the special assessment so a late fee was applied each month there was a negative balance. I'm happy to remove those late fees as a one time removal, but there would still leave a balance on there. If your able to take care of that balance I'll remove all of those fees ( should be a total of $220.00). I should have zero balance. I have proof of payment for each month since I bought my home. *AppFolio is showing that I owe $35.00 for November-I have proof that $110.00 cleared my bank on 11/03/2023. *App Folio shows 12/01/2023 unpaid plus a late fee. I have proof that it cleared my bank on 12/04/2023. *At this time, App Folio still shows that 01/01/2024 is subject to late fees on 01/16/2024. I have proof that it cleared my bank on 01/02/2024. If I had the option to add attachments, I could show my App Folio Register indicating that I have never been late but have been charges $20.00 late fees every month. I can provide proof of payment from my bank for every single month. I did not point a finger at any particular person. I do wish for their accounting to be reviewed. Last year when bogus charges were added to my account and Byers and Harvey were bugging me to death, I did finally reach this responder via phone and I did make it known that I was not going to tolerate carte blanche on my account and that there was zero possibility of my moving the waste can down the hill, around the building and back up a muddy hill where I had been bitten by a snake the year before. Our garages are very small. The can will not fit with my stand size car in the garage. If there are true Board Members on this HOA, I stand by the fact that there was zero correspondence. Neighbors on my end of the street claim the same. Again, I cannot add attachments that will prove I do in fact receive emails from the Management company...selective emails on their part. I would like this resolved by bringing my account to date at a zero balance as it should be.
