Business Response To whom it may concern: regarding complaint XXXXXXXX- ***** ********
Cape Fear Respicare, Inc. has attempted to complete and satisfy the concerns for the patient in this case. The issue centers around the eligibility requirements of Medicare/Medicaid. The result of the decline in services is that she was and still is not eligible for upgrades and additional equipment by these Government rules and regulations. To resolve this issue is for the patient, Ms.***** ********, to utilize the existing equipment or to purchase out of pocket for the equipment desired. In addition, her physician has not ordered any new equipment or upgrades for Ms. ******** which is also a requirement for all changes requested by a patient or beneficiary of Medicare. We have contacted Ms. ******** on numerous occasions to explain these concerns with her, she fails to realize it is out of our hands as to what Medicare allows her to receive. Consumer Response They have my oxygen contract but have repeatedly refused to honor the contract, failed to service the contract and refuse to provide product I can use The above mentioned company has my oxygen contract. In the three years they have had the contract they have changed reps at least 9 times. I have never had the same one twice. I am 88 and have repeatedly requested oxygen bottles I can handle. They have provided a tank that is beyond my capacity to move as well portable bottles that weigh 50 pounds and expect me to carry them with me. I live by myself and cannot handle them. I have requested the smaller portable unit so that I can leave my house but get no response even though my doctor has also requested it from them. He also got no response. He suggested I contact you with this complaint. Due to the regulations, we cannot use anyone else for two more years. What am I supposed to do in the meantime? Please help me.I just wish them to provide me with a unit I can use and to service it as per their contract. This is my second complain to you as I never heard back from the first one. Please, I don't think I'm being unreasonable to request equipment that I can use. I pray every day thethat we don't lose power because I don't know what I would do. I'm really nervous with hurricane season coming up.
Final Business Response To whom it may concern: Ms. ********, a patient of Cape Fear Respicare,Inc., has been in need of a more portsble and smaller oxygen unit for mobility.
