Complaint: Big A Auto sales refuse to fix my Lexus because they said I went over a couple of miles on my warranty. When I purchased the vehicle in March it had a ticking noise they supposed to had fixed but they didn't. At that point I had no means of transportation to work and back so I drove it until I thought the warranty was about up and took it back to be fixed, by this time they said I had went over on my miles and they don't want to fix it. They want 500 dollars up front out of my pockets to open up the motor and it may not be fixable so I will lose out on everything.I felt like they should have fixed it the first time knowing there was a knocking sound. My warranty came with no deductible and it was a bought warranty of 6 months or 7500 miles. The warranty expired on September 9, 2013, which I thought it expired on August 8,2013. I have not heard anything from there adjuster or anything from them trying to help me out.

customer was sent consumers right to cure letter because she was late on her payments. letter states that the last day for payment was on July 12. 2013 before it goes into repo status. she remained behind on payments. we kept trying to call her over and over but the numbers she gave us were all bad. she called us one day about a repair on her car. we told her to go see any mechanic about her issue. her warranty allows her to go to any certified repair shop. she purchased a warranty from an independent warrant company. we have nothing to do with servicing the warranty. her warranty had expired by her going over the miles. she kept calling our office and cursing badly at our staff that she wants us to fix her car even though the warranty had expired. one day she showed up and told us to fix it or we can keep it and left the vehicle on the lot. we sent her another letter of notice of repossession which stated the terms of repossession. she called us and said she would not discuss this matter anymore because she was going to get an attorney. either way the vehicle has been legally repossessed and and this matter is over. thank you

Complaint: My complaint also involves misrepresentations regarding the condition of the vehicle. I purchased a used vehicle on July 20, 2012 as of today September 6, 2012 the car is not registered in my name. It has been 48 days. On September 1st I was pulled at a traffice check and the tags came back registered to the car I transferred. I was advised by the DMV that the dealership has failed to do their job. I contacted the dealership and was rudely talked to by ***** ******* who also hung up on me when I questioned if the shop he was sending me to get my air conditioner fixed was a chop shop. My second complaint is that the day I bought the car, my husband took it back because A/C stopped working and immediately ***** tookt he car to the back of the dealership and put in a fuse which made the A/C work for minutes and subsequently continued to blow. They assured me the A/C was brand new and they had a warranty on it and that they would take care of the problem. My husband took a day off work to take the car to their repair shop. The A/C worked for 2 days and has not worked since. The dealership was made aware that the A/C once again has stopped working and has advised that their dealer do not have a used one and is unsure as to when he will get another used one. The car also had a transmission problem and I took the car back and they hinted that in situations like this the consumer would pay half the repair and they would pay the other half. I told them absolutely not, I am not paying for a repair that they knew about and sold the car anyway. They fixed the problem which was two sylenoids gone bad. Since I don't legally own this car and it is not titled in my name and I am paying $248 a month and put down a $1,500 deposit, I want my deposit and first payment back and this transaaction should be voided.

9-24-12qq Business called to verify complaint. Said that the consumer told them of the transmission trouble so he arranged the repair and paid to have it fixed. They consumer then informed them of the AC unit. The dealership said that it was under warranty. The new unit has been ordered and is in the office waiting for the consumer to come in to have it repaired. They have made their second payment on the vehicle. The husband seemed happy with the vehicle.The consumer should bring in the vehicle to have the AC repaired.

Consumer's Final Response
I spoke with someone in your office last week regarding the need to amend my complaint and was advised that it wasn't on the system yet and that I should wait until she calls me back on Friday 9/7/2012, but I have not heard from anyone in your office. Some very important information regarding the A/C unit has been omitted. The problem is that they presented to me that the compressor was brand new and had a warranty on it and that they would take care of the problem. The other problem is that I put down $1500 on the car with a payment of $248 monthly for a car that is hazardous to be on the road. Since the compressor is not working, the fan is not working and cannot keep the car's engine cool, nor can you defrost the car. I think it is bad business to tell a customer that you have no idea about the conditions of the cars that you sell, you just sell them. It is the dealers responsibility to know exactly what is wrong with each car they sell to a customer. If I wasn't under pressure and distress at the time of this transaction, I don't think I would have purchased the vehicle from them. Something needs to be done about their unfair and deceptive trade practices.
