Metro damaged our swimming pool, and failed completely to adress the matter.
It has been several years since the "Metro Concrete Pumping" company did a job at our house. In the process they damaged our swimming pool. They did not claim any responsibility in the matter. However, our pool remains damaged and it is very unlikely that we will be able to repair it ourselves.
In the process of pumping slabs of concrete around the pool their workmen pumped too much of the slurry that is used, and it blew into our swimming pool, behind the vinyl liner.
We were never told, or warned that this may occur . The resultant damage has rendered the pool unusable
We have not been able to find a pool company that will take on the repair project for a reasonable sum.
Due to the fact that a refund of the money we paid Metro would not come close to the repair costs of our pool, we see it as only fair that Metro pay for the costs to have our pool filled in.
Our pool would cost $20,000 or more to replace. It is the cornerstone of our back yard. It is our back yard, and it was, and has remained the Key reason that we chose to buy this house that we live in.
The cost of filling in the pool has been estimated to be has high as $7000.00.
Business' Initial Response
Mr ******* contracted Metro Concrete Raising in August of 2006(7 years ago) The contract was for raising the pool deck to relieve pressue on the ALREADY damaged pool deck and to level trip hazards. The purpose of the raising was to relieve the pressure on the pool coping to allow Mr ******* to replace the damaged liner.Metro concrete raising completed the project on 9/26/06.Metro Concrete Raising deducted $100.00 from the raising contract to compensated Mr ******* for the removeal of the 1/2 gallon of material, which was to be completed by his pool company when they did the previously scheduled repairs.Mr ******* stated that he would be completeing his pool repairs and replaceing the liner so that they could use their pool that fall.Mr ******* paid for the raising project on Oct 9th 2006.
It has now been 7 years and Mr ******* has still not done any repairs to his pool, which he states is the cornerstone of his yard...
It is in our opinion that Mr ******* is trying to hold us responsile for his pool repairs and using the BBB as an avenue to pressure us in to paying for the repairs.
Metro Concrete Raising has no liability or obligation to make these repairs and will not offer any more compensation to Mr *******.
Consumer's Final Response
(The consumer indicated he/she DID NOT accept the response from the business.)
I know that "Metro Concrete Raising" remembers who I am, and they know what pumping mistakes were made when they did our job.
In 2006 they claimed 0 (zero) liability just as they are doing today.
In their response to my complaint they state that my family hired them to "relieve pressure on the pool coping..., and to level the pool deck from trip hazards".
Well, the truth is that the 4' by 4' existing concrete slabs were NOT affecting the pool coping at all, but the slabs needed to be leveled. They were simply uneven, and did cause a trip hazard for our children and their friends. That was the only statement they made that was true. The balance of their response is a line of bull.
We had one other small issue that they would not acknowledge either. The holes that were drilled for pumping had been filled with a bright white colored mix of mortar. The bright white stands out on the grey slabs of concrete. We had asked them to make sure the color blended well with the existing grey, but apparently they did not listen.
As a result the white 3 inch diameter spots were standing out plainly, and look rather shoddy. Even today, 6 years later. At the time "Metro" management basically told me they would not correct this problem.
As far as the main problem goes......
We did not need a pool liner at the time. It was less than 6 years old. Liners have an effective life of about 20 years (twenty years).
Thanks to "Metro Concrete Raising" our pool liner has never fit again, after their workmen's performance at our home.
We did have an engineer do an analysis of the affected area of the pool, and they determined that among other things "Metro" should have informed us that there existed a good possibility for the slurry that they pump (under high pressure), to easily blow through as it did, and cause great damage.
Since the time that "Metro" damaged our pool the effects have gotten progressively worse. We can no longer use the pool at present (2013). The pool is now a complete failure, and a very nasty sore place in our back yard.
"Metro" has never changed their position of "zero liability", nor have they offered to fix the problem they created in any fashion. We think that this is a very poor excuse for a company policy, and an extremely poor stance for them to have.
I am hoping that the "Better Business Bureau" of which they are a member in high standing, will help us mediate this problem, and or, will make sure the public knows what kind of dishonest, negligent, and poor business people manage, and run this company.
Business' Final Response
In response to Mr *******s reply.
Mr *******s pool was in fact in dissaery at the time of the raising and he was going to replace or resucure the liner which had been damaged by the settled concrete. We did what we were contracted to do.We did not BLOW out the pool wall, a small amount of material seeped in to the space between the liner and the plywood wall(1/2 gallon). We offered a discount at that time which he accepted and paid us in full for the project. Why would he have paid for the job if we caused such ireverisible damage? Mr ******* states the pool is /was the cornerstone of his yard and yet it has taken him 7 years to respond. The allegations that we caused the damage and continuing damage is absolutly false. We believe that Mr ******* is searching for a scape goat to resolve his pool issues and we will not accept any liability for this.
We are a long standing member of the BBB and take customer service very seriously.
MR *******s comments about our company being dishonest and negligent are just a ploy to have us fix his problem, he is the one who is dishonest and is acting in a slanderous manner by making these statements about our company.
We stand by our previous reply and will not offer any compensation.
