I had a loan under pioneer/midcountry bank, and I've been applying for SCRA benefits, because pioneer charged a ridiculous amount of interest. I fall under a key provision state (****). Their response was that personal installment loans are not considered "retail installment contracts and therefore do not met gthe definition of an OBLIGATION outlined in **** Statute. the guide to **** Service Members Civil relief act from the Ohio state *************** dated 2012, page 35, it states: 7.1.1 Covered Debts "The 6% interest cap applies to all obligations and liabilities incurred by a servicemember, individually, jointly with a spouse or in the name of a closely help business entity, In addition, courts have held that the cap applies to Chapter 13 repayment plans and foreign judgments". A Liability is a debt that you must pay off. All Personal loans from pioneer does fall under the category.I don't respect the fact they aren't taking accountability of fraudulent interest rates to service members. I am trying to handle this without an attorney.
