    Our initial contact person was Tadd ******* in March 2022. The preconstruction meeting happened and we finalized the plan with Tadd. There was an issue with the budget for the appliances because it was not made clear to us that the budget didn’t include the washer and dryer. So, already over budget because we weren’t going to buy the laundry appliances out of pocket. It would be part of the whole loan. Contacted them a few weeks later, waiting on surveying and the city regarding the plot. A couple of weeks later we contacted Tadd and he said the city said everything should be ok but we were still waiting on information from a survey crew. Initial reports from the survey crew came back ok but after further digging, they discovered work would be required to make the plot buildable. Tadd and our realtor tried to coordinate with the lot seller to have the lot price reduced in order to make the plot buildable without increasing the overall price point. The seller refused to budge. Instead of getting updates about this whole back and forth, we got silence from Tadd, but not our realtor. After further work from the surveyors and the city, we found out that the plot was not buildable. Because the seller advertised the lot as buildable, he was now in breach so should have given the earnest money he received back. He refused. Fieldstone decided on their own to file suit for the money to be returned. It was and we would be billed for the legal services used on “our behalf”, so we lost the earnest money either way. It was around the end of July that Trent ******* came into the picture. We had heard nothing since the Cancellation was signed mid-July. Trent said that a portion of the earnest money would be returned after all of the invoices and receipts were tallied for the money Fieldstone spent trying to make this deal happen. We asked multiple times for access to these. As of the writing of this on Sept 9th 2022, we have seen neither the receipts nor any type of refund.

    On behalf of Fieldstone Family Homes (FFH) I apologize again that this off-site (non builder owned) lot purchase, and build wasn't able to happen in a manner that would still meet the client goals in terms of timing, home style, location, and most importantly budget at this site. The vacant land they found with their agent was definitely too good to be true in the listing and misrepresented how much work and expense was involved in making it buildable. Neither the clients or Fieldstone Family Homes (FFH) knew the depth of those issues and costs until well after a contract was in place with us that they agreed to invest $5000 as a non refundable deposit to work on their behalf through the lot purchase agreement, due diligence, design, survey, and pre-con process. In our purchase/build contract their $5000 isn't "******* money" it is an immediate construction deposit for work performed by builder on behalf of buyer/builder for the contracted site without any refund language, other than they could select another lot with the builder and transfer any remaining deposit towards a new site purchase. We have internal and external expenses in selection and pre-con meetings, paperwork filings, drafting blueprints, and admin costs, plus any subcontractor, engineer, survey, and legal fees accrued in preparing for a building permit or Lot and construction loan closing that need to happen before the start of actual construction. It did take a longer time than usual to learn all that all that was needed to make this a buildable lot. But once we had a handle on it, we let the agents, seller of the land, and/or clients know directly that this was a bad idea to keep moving forward on. We would have liked to build them a house, it just didn't make sense given all the land challenges and expense and wouldn't have been possible to stay anywhere near the budget goals. So we suggested they Cancel the contract before owning a piece land that we couldn't build what they had asked for on, or absorb any more expenses in preparation work from us. There is an extreme amount of dirt work and expenses way beyond the included allowances- not to mention the sewer/utilities, easements and recording plats/docs that needed to be done which would take many months. It would have cost them a whole lot more money, and all of us a lot more time and work than was included with the pricing allowances to the point that the build would not have been affordable for them if we would have kept working towards a closing on the lot and construction financing. We thought letting them know up front was the better avenue. :Note the clients were represented by their own agent who is familiar with new construction and has built many other clients Homes successfully with our company, both on our lots, and off-site purchase build situations. Once we knew the brevity of the situation we offered to apply their full deposit ($5000) towards the purchase of a house/and or lot build that we already owned or knew was readily buildable in other area or floor plan styles still within the original budget. I don't think anything fit for them in those other areas or floorplans, even though i wasn't directly involved in those discussions. I can see that on or about July 29th there was an email we offered to refund $1500 of their deposit. This was supposed to be a good will gesture, thank you for the opportunity, and apology that this deal didn't work out for any of us charging only a bear minimum for some of the hard subcontractor costs against their deposit and having FFH absorb the rest entirely. As I understand that was met with a refusal to accept, and the clients expected all of their money back and/or a detailed formal receipt of where it had been spent.... which is technically irrelevant as the entire amount was agreed upfront to be a non-refundable deposit. The clients may not have understood that as evidenced by the wording of ******* money in the review- As it sits today we are still willing to refund $1500 as goodwill, I understand $5000 is a lot of money to spend for a deposit to not be able to build a house on the lot they wanted, but the time, money, and work involved to get to a point of a building permit or construction loan closing far exceeds that amount for any builder in costs. That's why we ask for a minimum of $5000 non-refundable deposit. Many other builders ask for much higher non-refundable amounts just to get started in the process. We will have the agents reach out to the clients again and see if there is an amicable resolution to be had besides our apologies and a partial refund. thank you,********************* Builder/Co-Owner Fieldstone Family Homes *** ************

    Furthermore, after the deal fell through Fieldstone response is to claim it was never ******* money in response when loan documentation as well as the transfer receipt clearly states it is. The only email ever sent was an addendum they wanted us to sign accepting the lower amount back. We specified we would like receipts and invoices documenting the additional costs requested by us as well as our agent which Fieldstone continues to ignore to this date. In additional fieldstone co-owner ************************* communications were incredibly dismissive and disrespectful at one point saying that we should talk to him on the phone like a man rather than accepting written (and properly documented) Communication. This type of behavior is what you can expect from fieldstone which has been consistently manipulative, coercive, misleading and misrepresenting. I can provide documents and manuscripts from these communications if needed.
