Complaint
Valley View Builders Inc., 23800 Pickett Ave. N, Scandia Mn 55073 was hired to do a remodel project. They provided a written Construction statement for $30,400 to complete the job. They verbally said it would take about 6 weeks to complete. Changes were made to the plan with input from the homeowners and Valley View Builders. At no time, prior to or during the work, did Valley View Builders indicate that any of the changes agreed upon would result in additional costs. 14 weeks into the project, Valley View told the homeowners that there would be additional charges. They presented a $14,661.82 "supplement" bill (48% increase). The homeowners challenged the bill and send a letter stating that all of the "supplement" charges were part of the construction statement and/or agreed upon between Valley View and the Home owners during the project. In addition, Valley View did not complete the job and left the work site unfinished. Valley View is threatening to file a Mechanics Lien on the property and sue for foreclosure if the home owners do not pay $14,661.82.

Business' Initial Response
I am writing in regard to the complaint filed against Valley View Builders. We have been in business for fourteen years and have not had any complaints filed against us.
A written Construction Statement Estimate was given to the customer. There was knowledge by the customer that this project would probably have changes to it given the nature of the existing house. As the project moved on, there were changes made from the original print and also "customer requests" that were not on the print or included in the Construction Statement Estimate.
We are trying to resolve this with the customer. During our first conversation with the customer, we were told by them that they "would slander our name all over town". The most recent contact was this morning. We are hopeful that we will reach an agreement soon.
Please advise us to whether we need to explain further or if you need more information.

Consumer's Final Response
I would like to further discuss this case. I do not agree that the company made a good faith effort to resolve this issue. The lead contractor and co-owner we hired will not return our calls. The president of the company is the one who is responding. He was not the person we did most of the initial planning of the project with. The co-owner was the lead until his prior back injury prevented him from working. The President has not conceded a single point in our negotiations even when it states clearly on their bid that they would complete that service. He is not negotiating. The response he submitted is not factual. I have written letters from the Truss Company and the architect that confirm the fact that Valley View Builders participated in the development of the Build Plans and were deeply involved in the process. They deny that fact in their response. They also state that they told us there would be additional costs. This is not true. They never said verbally or in writing that any of the remodel work would result in additional costs. He also stated that we have not made any offer to settle. I have sent him a letter listing all of the items I am willing to negotiate with. Again, an untruth.

Business' Final Response
Please be advised that Mr. Carlson and Mr. Ryan met on Friday to discuss settlement. Mr. Carlson presented Mr. Ryan with 3 different proposals. The one with the lowest dollar amount stated that Mr. Carlson would close and define as satisfied the complaints with the Better Business Bureau and the Attorney General's Office and would not file a complaint with the Dept of Labor and would not provide any negative reviews of Valley View Builders. However,the one with the highest dollar amount he would not do any of these things.
Prior to this meeting Valley View Builders had made two offers of settlement. Mr. Carlson did send a letter, but a dollar amount was not mentioned.
Valley View Builders Construction Statement Estimate was based on the original plan presented to us. Valley View Builders did not participate in any further plans that were produced after that. There are numerous plans and non of which Valley View Builders was a part of.
The "service" as Mr. Carlson calls it was completed when the framing inspection passed.
Valley View Builders has the letter from the truss company and was in communication with them during the project. As the letter states, "contractor did make mention about changes to windows and other wall within the existing house and that some of the changes were not figured for and that the plan was inconsistent in some of the dimensions. It also states "the homeowner stated how much extra will this cost". Mr. Carlson was aware of changes and extra cost.
Valley View Builders will continue to work towards a settlement with Mr. Carlson.
