Complaint Category: Failure to honor a contract or agreement

Complaint: I had a proposal of $2496 for my roof. then I had a post card offering -$850 the price. I called and they said no, they would not do it for that price
The contract was done in June for $2496 for my gazebo roof, and a small shed. I thought the price was too high, I received a post card offering $850 off the contract price or interest free payments. I called to set it up and they said they would not honor the post card. they said it was 7% off the price, but the post card does not state that- i called and when I stated exactly what it said the said they will not honor what the post card they mailed me said.

Business Response
Minnesota statue prohibits us from offering any discount on an insurance claim. The letter sent out to ********** states in order to receive the full $850 discount it requires a minimum purchase of $8,500. We apologized to her over the phone and informed her it would be illegal for us to honor the discount per the Minnesota Department of Labor and Minnesota Attorney General regarding insurance claims.

Complaint Resolution: Company addressed the complaint issues. The consumer failed to acknowledge acceptance to BBB.

Complaint Category: None of the Above - Product Quality Complaint Issue

Complaint: Product, LeafGuard gutter system is not performing as indicated in both advertising and sales presentation.
I signed a contract for install of said gutter system July 28, 2011. Install went as expected. That following wimpy winter with very little snowfall my home had ice dams and huge icicles I had never had before with the old standard gutter system. The Leafguard system is not appropriate for winter portions of the country. Also this past summer during heavy rain I had huge waterfalls over my front main door falling to the steps making use of the door impossible. ****** came out to install a diverter but did not have the right part and said they would be back "when a service person is in the area." That was almost 4 months ago, thankfully (or unfortunately) we have had very little rainfall. I still want the diverter installed OR best settlement would be Leafguard removed and standard gutters installed at their expense. I paid almost $1800 for my small house and feel as though I have been deceived of their performance.

Business Response
We have been in touch with Mr. ****** and are working with him to schedule a time to address his concerns. Our records indicate that he called us on April 9, 2012 to report his concerns with ice and our service technician met with him on April 16, 2012 and discussed insulation and ventilation issues that are the likely cause of his ice dams. He contacted us again on June 19, 2012 and reported that he was having over-shooting water over the front door. We came out on July 6, 2012 in response to that call. We will continue to work with him and make any warranty-covered adjustments until he is satisfied.

I know that ****** is doing what they feel is a remedy to the problems this gutter system has caused. One of their techs was out on Sept 4, 2012 by the name of Gus. He installed an additional hood-type piece which he felt would take care of the water fall over the front door during heavy rains. However, as we all know we are in a severe drought and I have not been able to assess if this has taken care of the issue. The BBB communication listed Sept 14. 2012 as the deadline to consider the case resolved but I doubt we will be receiving significant rainfall by that date, (one can hope). I would like to request an extension of this acceptance date. As far as ice dams I know these were a huge issue city wide last winter and am considering heat tape, I have not had time to check on pricing as of yet, if ****** has any suggestions I would be appreciative. Thank you. ****** ******

Complaint Resolution: BBB determined that despite the company's reasonable effort to address complaint issues, the consumer remained dissatisfied.
