Complaint: I am disputing a charge for my son who is a minor. Associated is charging him $100.04 for an overdraft under $3; he was told he could not overdraw. I am disputing a charge on behalf of my son who is a minor. He was double-charged by a merchant, causing him to be overdrawn by around seven dollars. For this, Associated Bank is charging over one hundred dollars in fees. He was told when he signed up that the bank would not allow him to make purchases if the purchases were not covered. I was there when they told him that and I asked again about this policy and was reassured that it wouldn't happen. Originally, my son was only over by two dollars, but the double charge for the same service by the merchant then caused the extra five dollars and fifty cents.
Desired Settlement: I want a charge of 110 dollars to be removed and his account restored.

Dear Ms. *******, This letter is in response to the complaint that you filed with the Better Business Bureau of Minnesota and North Dakota regarding your checking account number ending in ***. I sincerely apologize that our service prompted you to take further action for resolution. As we discussed, we determined that the transactions from Musicnotes.com are valid and posted correctly. The transactions were authorized on February 25, 2015 and March 8, 2015 for $5.50 each. The February 25, 2015 transaction left your account overdrawn by $1.62 and the March 8, 2015 transaction of resulted in an overdrawn balance of $7.12. We assessed a $35.00 overdraft fee on March 9, 2015 and a mailed you a Notice of Insufficient Funds. The notice disclosed that a deposit may be needed to bring your account to a positive available balance to avoid any additional fees and also indicated that if your account is overdrawn for more than five consecutive business days, a Continuous Overdraft Fee of $7.00 per day will be applied. Your account was charged the $7.00 per day for a maximum of ten days resulting in an overdrawn balance of $112.12 on March 30, 2015. Because the balance was overdrawn for 45 consecutive days, Associated Bank closed your account on April 13, 2015. As a customer courtesy on April 20, 2015 we removed the ChexSystem record for you and ****** and on April 22, 2015 we refunded the fees of $105.00. The remaining principal balance owed is $7.12. When you opened this account you indicated that you were told the account would not allow purchases to be authorized if funds were not available. This service is known as the Debit/ATM Card Overdraft Service and is a part of the overall Discretionary Overdraft Privilege Service. It provides your personal checking account the option to choose whether or not you would like ATM and on-time debit card transactions to be authorized if sufficient funds are not available for the transaction. One-time Debit Card purchases are point of sale, non-recurring transactions. Recurring Debit Card transactions (e.g., gym memberships, cell phone payments, stored card transaction, etc.) and non-ATM/Debit Card transactions (i.e., checks, ACH withdrawals, online banking/telephone banking transactions, etc.) which cause an overdraft may be paid by the bank even if you are not Opt In to the Debit/ATM Card Overdraft Service. Because you chose to have your debit card number stored with Musicnotes.com, the authorizations are considered recurring transactions, and are not subject to the Debit/ATM Cared Overdraft Service. If you prefer the authorizations to process as one time transactions, you will want to enter your debit card information with each purchase.
