Complaint: Sold a lemon car that had been involved in an accident (not disclosed) we found out it was past the 30 day return. Spent $2000 trying to get road safe Sold a misrepresented car that had been in an accident and had undisclosed severe electrical issues. Spent $2000 over two months trying to repair to road safe condition and then the electrical system shorted out as the roof was full of water (potential fire). After much arguing the dealer took the vehicle back but refused to pay for the costs incurred trying to get it road safe. Was told by two separate companies this should never have been sold to us and the dealer would have seen the damage prior to sale and never disclosed it. Dealer admitted they saw the damage when we had it up on a hoist at return time, but said lots of cars have that and said it should have been returned within 30 days, however we were not aware of the severity of the accident until we hired an independent adjustor and third mechanical consult to verify what two other locations had noted. Dealer was rude and accusatory and said I should be happy that they were even taking the vehicle back as it was an as-is purchase. I contend that they misrepresented a vehicle they knew had been in an accident with revealing the info and could have had a much more serious issue if the electrical system had started on fire or our daughter was in a crash as the lower crash bar was damaged and inoperable. In addition the steering wheel had been replaced because of air bag deployment (also not disclosed).
Desired Settlement: I am asking for the additional $2000 (total rebuild of the front end, thermostat and throttle replacement). Dealership refuses to discuss. All money was put into the car to make road safe and even drivable, but the electrical was not fixable and that was the final attempt. We then hired independent adjustors. Throttle -$500, front end work -$1400, Thermostat - $280 Electrical unrepairable
Business Response: Initial Business Response /* (1000, 8, 2015/01/21) */ Ms. ****** purchased a 2005 Ford Escape (VIN *****************) on 27 September 2014 from Apple Used Autos. The vehicle was represented at the time of sale as 'As-Is' and correctly displayed the required Buyers Guide noting the As-Is condition. The customer received a copy of the Buyer's Guide. Original document with customer signature acknowledging the 'As-Is' status as well as agreeing she was provided a copy of the Buyers Order is available for inspection. The Buyers Guide notes the following: 'You will pay all costs for any repairs. The dealer assumes no responsibility for any repairs regardless of any oral statements about the vehicle.' Additionally the sale of this vehicle was backed by AppleAutos 7 day 300 mile return or a 30 day exchange policy. The customer was also offered the choice of several extended warranties to cover future repairs. Ms. ****** declined all these options. Original with customer signature available for inspection. Apple Used Autos contacted Ms. ****** two days later on 29 September by phone and again on 30 September via email as a follow-up. She did not respond to either communication. Call records available for inspection. Three months later Ms. ****** contacted Apple Used Autos demanding a full refund of the purchase price of this vehicle plus any and all costs of after the sale repairs. At the time of this call to AUA the customer acknowledged that she had not contacted this store prior to express any concerns or to ask for assistance with the Escape. Included in the pre-sale due diligence Apple Autos performed is a vehicle history check through Autocheck/Experian and that report shows a clean history: no accidents reported. Copy available for inspection. Even though the AppleAutos customer satisfaction guarantee had long since expired we agreed to repurchase the Escape back from the customer. We promptly repurchased the vehicle from her at the exact price she originally paid for the Escape several months previously less tax, title, license or other supposed after-sale repairs. We then performed an extensive inspection on the Escape. We did make the determination that the vehicle did not evidence any indication that it was in a 'severe' accident. An air restraint (airbag) deployment is logged in one of the vehicle computers as a 'hard' code and is not subject to deletion from the system memory: this vehicle has not had its supplemental restraint system deployed. The airbags and related OEM safety equipment are original to the vehicle and are in good working order. The condition and prior damage to this vehicle as described by the customer are simply not supported by the facts. Vehicle inspection records are available for inspection. Further, we determined the drains for the sunroof were plugged with road debris, a common maintenance item, we cleared the drains and water now runs through the drainage system normally. We regret that Ms. ****** is not satisfied with her experience with us. We made an exceptional post-sale adjustment for Ms. ******, an accommodation that at the time she agreed would settle the matter. When Apple Used Autos agreed to repurchase the Escape from Ms. ****** we agreed that AUA would not consider any support outside of the original purchase price of the Escape. We shook hands and issued her a check. Given the facts of the instant case we are not able to move forward with additional adjustments, refunds, or other considerations at this time for Ms. ******.
