I have a very serious problem with a business here in Halifax using my registered companies name. My name is ***********************

I have a very serious problem that I can't seem to rectify without expensive legal counsel. So here I am asking the question to you. I need help.
I have a registered business with the province that I had to fight very hard for and now I am at my wits end on trying to protect it and nobody seems to help so I am going to be forced to use legal action. My registered name is ***********************and I have found since I started promoting my business that soon after "Coat of many colors" and "elite trade painting" in *************************** started using the same name with their telephone number attached to it, they are at the very top of the Google search page. I have called them a few times to try and discuss this very serious issue. I even explained I could not go ahead with a very expensive radio ad campaign I was about to launch due to the fact they were using my name. I have asked them to stop and they told me to basically go ************. ***********************************************************************************************
I am at a loss. I cannot promote my business without attracting them more business. I am losing a ton of revenue. I had to stop an $8000 radio campaign due to the fact that he appears as ***********************when potential clients "Google" my business name.. I need to know what I can do to make this ****** stop and start using their own names. ******************************************************************************************************************************************************************************************************************************

I need them to just stop using my registered name and use their own. I dont want to see my registered name attached to their telephone number any more. I am losing a great deal of revenue. ********************************************************************************************************

As owner of Coat of Many Colors Inc. we take great pride in our name and our company and have never tried to imply we are anyone other than who we are. We have been in business for over 16 years now and I have personally been in this trade for over 20. We've worked in ever sector of the business, from residential to government, which has enabled Coat of Many Colors Inc. to establish itself as one of the top painting companies in the province.

This issue with Halifax House Painters is the first BBB related issue we've ever had to deal with. The name Halifax House Painters is a very vague name in itself and the people involved with this company are somehow trying to take ownership of these terms. An analogy would be like a company known as "Best Hamburgers in the World" trying to trademark those terms and going after say McDonald's because they use those terms in their marketing. By them choosing that name, with those very common terms, they've already made the decision to get confused with pretty much every other painting company within the HRM who paint houses in Halifax. **************************************************************************

Looking beyond all of this, I still treated the owner, or whomever it was, who contacted me from Halifax House Painters, with respect and I never used such terms as they are insinuating. I have also never received ONE call from anyone who mistakenly thought that we were the company Halifax House Painters. Not once. If I would have received such a call (which I did not) I would never have implied I was them. Why would I? Coat of Many Colors Inc. does not have to resort to such tactics. As I have mentioned, this company has been around many years now and it **** be here for many years to come and we are quite successful on our merits.

Another analogy comes to mind. Our company name is also the name one of Dolly Parton's songs. Perhaps I should contact her because pages related to that song pop up on Google before my company page does. Would she take me seriously?

In closing, just because I like trying to keep the peace and not because I have to for any other reason (because this benefits me in no possible way), I am going to speak with my marketing people at the Yellow Pages and see if I can get the term "Halifax House Painters" removed from the title in which it sometimes appears along with the title of my own company. I don't have to this for any other reason, but I **** look into it. ************************************************************
