Government Action

The Attorney General of Kansas filed suit against Publisher's Renewal Service Co for violations of the Kansas Consumer Protection Act related to the telemarketing of a magazine subscription service and violations of the Kansas No Call Act. According to the suit, Publisher's Renewal Service and its distributors allegedly: 1. "Knowingly made misrepresentations regarding consumers' rights...by specifically stating that consumers had three (3) days to cancel their orders, when consumers could, in fact cancel at any time" (KSA 50-626). 2. "Willfully concealed supressed or omitted a material fact in their transactions with consumers, specifically that consumers could cancel their orders at any time." 3. "Charged fewer than ten Kansas customers' credit cards for the purchase of magazine subscriptions, prior to receiving written and signed confirmations from these consumers disclosing in full the terms of the transaction as required by KSA 50-627." On July 1, 2010, Publisher's Renewal Service entered into an Assurance of Voluntary Compliance with the Kansas Attorney General's office. The company admits no wrongdoing and agrees to the following: 1. The company agrees to comply with all Kansas laws, statutes, rules and regulations relating to consumer transactions in Kansas. 2. Agree to refrain, and to be permanently enjoined, from misrepresenting consumers' rights. 3. Clearly and conspicuously disclose their refund policy. 4. Refrain, and be permanently enjoined, from making oral representations that, directly or indirectly, contradict terms or language contained in written materials sent to consumers following any solicitation made on behalf of Publishers Renewal Service 5. Set up a customer service line for general customer inquiries and if any customer expresses a desire to cancel, PRS must advise consumer of specific steps that are needed to be followed to cancel. The cancellation requests must be recorded. 6. PRS must promptly honor all requests for cancellations and issue appropriate refunds. 7. The respondents must refund Kansas residents that requested refunds and pay the Office of the Kansas Attorney General $135,000.00.
