The BBB will process complaints concerning new homebuilder defects within the first 30 days that the defect has been detected** by the homeowner. Please note the following steps: *If the issue is beyond the 30- day period the consumer should file a complaint with the TRCC (Texas Residential Construction Commission). *A SIRP (State-Sponsored Inspection and Dispute Resolution Process) must be undertaken. The SIRP will provide a third-party inspection of the home with alleged defects. *Consumers will be responsible for a SIRP filing fee; however if the inspection finds that the home has the defect(s) the homebuilder is required to reimburse the homeowner. *More information including downloadable forms may be found on the TRCC website at: www.trcc.state.tx.us *The TRCC inspection is a mandatory first step that must be taken before a homeowner can take any legal action against a builder. *After the final inspection report is issued, if the builder does not repair the confirmed defects, homeowners are left to pursue either binding arbitration or litigation on their own. *If the homebuilder is a member of the BBB the homeowner may come to the BBB for a binding arbitration hearing. Arbitrations between BBB members and their consumers will be conducted at the Houston BBB for free.**The TRCC has the stated homeowners who believe their homes have defects can file for a SIRP 30 days after notifying their builder about the alleged defects. The builder may inspect the home and take whatever correction action is needed in that 30-day period. TRCC officials have allowed that the BBB of Houston may handle the consumer complaint in the initial 30-day period prior to a SIRP being undertaken. According to the TRCC it is possible for both parties to conciliate and/or mediate the issues at the BBB during this initial 30-day period. Only after a SIRP has been completed and the TRCC appeal panel has reviewed any appeals then the TRCC's jurisdiction ends and the BBB binding arbitration may commence.
