Complaint: Date of service: 10/05/2012. Harritex concrete was hired to remove and rebuild my concrete driveway and patio. The work performed is substandard. Water pools about 1 inch deep on both the driveway and the patio. The water flows toward the house. The driveway grade is not done correctly. Both my cars hit the street when we back out of the driveway. We asked the contractor (Harritex Concrete) to repair the patio and drive way. He tried to correct it by adding another layer of cement on top of the patio, which is peeling off. No correction was performed for the driveway. Harritex concrete (*****) promised to get it fixed and now he does not take my phone calls. We now get calls from someone who claims to be a sub-contractor and threatens to lien my property because he was not paid.

Desired Settlement: We like to get the water pooling corrected on the driveway and patio. we also need an explanation about the phone calls from the sub-contractor, if the sub-contractor is not paid then e needs to be compensated.

Business Response: Hello Mrs. ***** and Mr. ****,
I'm very sorry for the delay of this response. I am currently in a small town in Mexico with no phone signal nor internet access. I understand that we have an uncompleted contract with Mr. ****** which I intend to resolve as soon as I get back to Houston, however, I will explain what happened and the reason why I couldn't complete the job. When I signed the contract with Mr. ******,  I decided to hire Mr. ********* ***** as a sub-contractor to execute the project. As soon as he completed the project, I paid him with a check for the agreed price of $3500 and told him not to cash the check until I collected final payment from Mr. **** ******. However, Mr. ********* ***** went ahead and cashed the check at a little store called "***** ****" located at **** ****** Rd. When I tried to collect final payment from Mr. ******, he said he had standing water on his new patio and in an area of his new driveway. We needed to correct the problem before I could collect final payment. I contacted Mr. ********* ***** (sub-contractor) and told him about the problem. He promised to go and correct the problem right away but failed to do it until he got a call from Mr. ***, the store owner with the notice of the returned check of insufficient funds. Then, Mr. ***** told me about the returned check and sent a couple of guys to correct the problem which was not properly done. Meanwhile, I contacted Mr. ***, the store owner, and agreed to pay him for the returned check and made a partial payment of $500 and agreed to pay him installments. Unfortunately, I got arrested and deported, therefore I could not complete the deal. However, I will try my best to resolve this legal situation to make it back to the U.S.A as soon as possible and resolve the problem of the returned check and the standing water in Mr. ******'s new pavement. I sincerely apologize for the inconvenience and look forward to resolve these problems as soon as possible.

I have reviewed the response made by the business in reference to complaint ID *******, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

This complaint cannot be closed, Harritex Concrete explained why there was a delay in his response. Mr ***** says he will correct the problem but there is no hard date to when this will be resolved. In the mean time, I still have to deal with the Mr. *****'s attorney who is thretening to lein my property. Not to mention the job is still incomplete and there is standing water that needs to be cleared every time it rains.
