On September 8, 2021, The Consumer Financial Protection Bureau (CFPB) filed a complaint accusing LendUp Loans LLC of violating a 2016 consent order. Case #: 3:21-cv-06945.
In 2016 the CFPB ordered LendUp to pay $1.83 million in consumer redress and a $1.8 million civil penalty to stop misleading consumers with false claims about the cost of loans and the benefits of repeated borrowing.
In the complaint filed on September 9, 2021, the CFPB alleges that, in violation of the 2016 order, LendUp has continued with much of the same illegal and deceptive marketing. The CFPB also alleges that LendUp illegally failed to provide timely and accurate notices to consumers whose loan applications were denied.
On December 21, 2021, LendUp entered a stipulated final judgement with the CFPB.
Without any admission of wrongdoing, LendUp has agreed to stop issuing any new loans and will not collect on certain outstanding loans. They have also agreed to not sell consumer information or to make any misrepresentations when providing loans or collecting a debt. LendUp is also ordered to pay a civil penalty in the amount of $100,000.00.

If you still owe money on a loan, we are happy to tell you all outstanding debts have been forgiven and no future collection attempts will be made by LendUp or any LendUp affiliates. Going forward, if you receive a collection communication from any company claiming to represent LendUp or claiming you owe money for a past LendUp debt, be advised the company does not represent LendUp and your LendUp debt was forgiven.
Existing LendUp customers may access their dashboard through December 31, 2021, to obtain loan information, including loan agreements. After that time, record requests must be made through our agent who will be identified at a future date.
