Complaint: This company failed to advertise a cancellation policy where they charge a $12.00 fee to do so. On 10/13/13 I purchased gym equipment from this merchant. On the site, there was no mention of a cancellation fee, nor a charge to ship merchandise back (only stating that you would receive a 100% refund within 30 days). I contacted the company on 10/15, after leaving an email message on 10/14 (they were not open due to the holiday), cancelling the transaction. The customer service rep stated that the item was processed for shipment, and that there would be a $12.00 fee for cancelling the transaction. Again, this was not stated in any policy.
Desired Settlement: Full refund of $219.95.
Business Response: Initial Business Response /* (1000, 9, 2013/12/02) */ Received business response via email on 12/2/13: Mr. ****** is correct in the fact that Fitness Anywhere LLC (''FA'') did not state, at the time of his purchase, that orders cannot be cancelled after hitting submit. FA does not allow cancellations as there is an automatic processing system to expedite all orders for every customer. However, we have clarified our shipping information so that this information is now obvious before purchase. It reads: ''Once submitted, orders can't be cancelled or refunded until you've received your shipment.'' We are now aware of Mr. ******'s objection to the $12 fee. Mr ****** did not state his frustrations with any of these policies or concerns over the carrier's $12 fee at the time of customer contact on October 15, 2013. At that time, Mr. ****** was notified of this fee as well as other options to avoid the $12 fee if he would have preferred to choose them (case#******). Mr ****** chose to have the shipment recalled and thus have his cost refunded in full, less the cost of $12 charged by the carrier. When an order is recalled, there is a cost incurred by the carrier to send the shipment back mid-shipment and is thus not covered by FA. Mr. ****** also referenced a shipping fee for any return. FA has a 30-day, 100% money-back, satisfaction guarantee and a one-year limited replacement warranty and does not charge for shipments over $150. FA refunds any product cost within the 30 day policy 100% without additional charge. Our Customer Service Agents are available to help in any situation and willing to work with any issues to fully meet the needs of our customers. FA is willing to refund the full amount as FA acknowledges the wording on our cancellation policy was not fully stated at the time of purchase.
