Additional Complaint Information

oDesk Corporation came to BBB's attention in July 2007. Recent complaints state that individuals are paying a contractor through oDesk for a job, generally web design or search engine optimization and, though the contractors are paid, the work is not done to completion or is not done satisfactorily. oDesk clients are then having a hard time reaching the contractor for completion of work or a refund. When individuals contact oDesk for assistance with their dispute against a contractor who has not completed work they state they either do not hear from the company, or hear from a representative who says he/she will look into the matter, but does not.

In response to the above complaint information, the company addressed our concerns and sent us the following:

"There are two types of engagements on oDesk - fixed price and hourly. Fixed price assignments are deliverable-based, and payment is made based on deliverables and/or milestones at the Client's discretion, not the time worked. Conversely, hourly assignments are completely time-based and not attached to specific deliverables or milestones. When you choose an hourly assignment, you are agreeing to pay for the hours worked, and not specific deliverables. oDesk provides a time tracking system that gives the client complete visibility into the work being done. If the Client is not happy with the work quality, he/she simply ends the assignment. However, past hourly wages cannot be reclaimed. With that being said, oDesk does offer dispute services with explicit guidelines and policies.

1) oDesk has a clear and effective Dispute Resolution Policy that successfully solves many Customer Complaints. Fortunately, less than 0.5% of transactions on oDesk are disputed, but we treat every single one with due diligence to protect our customers from a poor experience. It is imperative that we provide customers a good dispute experience. Customers, who do file a dispute at oDesk with a contractor, are retained at a higher rate than customers who do not file a dispute. For more details on our dispute resolution please review the text directly from our oDesk User Agreement: Section 2.9 For Hourly-Rate Contracts only, Clients may dispute hours during the dispute period following the close of a weekly invoice period. It is the Client's responsibility to review the Work Diary and Time Log of every Service Contract on a weekly basis and to file any disputes on a timely basis. Once the dispute period has passed, the charges are accepted by the Client and can no longer be disputed and can only be refunded by the Contractor. Disputes can only address the hours billed, not the quality of the work performed or deliverables. oDesk will promptly investigate the Time Log to determine, in its sole discretion, whether an adjustment is appropriate. oDesk's determination shall be final.
