What To Know Before Purchasing a Hearing Aid

Hearing aid dispensers are licensed by the Speech-Language Pathology and Audiology and Hearing Aid Dispensers Board. If you have any questions, or if you wish to obtain a complaint form, you can visit www.speechandhearing.ca.gov or call 916-263-2666.

Receipts
*No fee should be listed as "non-refundable" on the purchase agreement.

*Receipts negotiated by trainee licensees must be countersigned by the supervising dispenser

*Hearing aid dispensers should use the licensed title "dispenser" on receipts.
*The terms of any guarantee or written warranty be included on a written receipt provided to the purchaser

*Written receipts, signed by or on behalf of the licensee, should contain all of the following:

*The date of consummation of the sale.
*The make, serial number, and model number of the hearing aid(s)
*The address of the principal place of business of the licensee, and the address and office hours at which the licensee shall be available for fitting or post-fitting adjustments and servicing of the hearing aid or aids sold.
*If the hearing aid(s) is(are) used or reconditioned if that is the fact.
*The license number of any hearing aid dispenser or temporary licensee who provided any recommendation or consultation regarding the purchase of the hearing aid.
*The terms of any guarantee or written warranty

Warranties

The California Song-Beverly Consumer Warranty Act provides a 30-day warranty on all new and used hearing aids sold.

The following warranty language must appear on the purchase agreement/receipt delivered to the buyer: "This assistive device is warranted to be specifically fit for the particular needs of you, the buyer. If the device is not specifically fit for your particular needs, it may be returned to the seller within 30 days of the date of actual receipt by you or completion of fitting by the seller, whichever occurs later. If you return the device, the seller will either adjust or replace the device or promptly refund the total amount paid. This warranty does not affect the protections and remedies you have under other laws. "

Warranties on consumer products must contain:
*The warrantor's name and mailing address.
*Who is protected by the warranty, including any limitations.
*Precisely what parts, components, or characteristics or properties the warranty covers and what it excludes.
*What items or services the warrantor will pay for, and those, if any, for which the buyer must pay.
*When the warranty term begins (if other than the date of purchase).
*The warranty's duration.
*Whom to contact to obtain warranty service (including names, addresses, and telephone numbers).
*Step-by-step instructions to follow to obtain service.
*Any expenses the buyer may be required to pay.

Returns

If the buyer returns the device within 30 days of the date of the delivery or completion of the fitting, whichever occurs later, the seller is required and has the right to attempt, without charge and within a reasonable time, to adjust, repair or replace the device.

*Both the buyer and the seller should keep accurate written records of the dates of all adjustments.
If the device is still not specifically fit for *the buyer's needs, the device may be returned for a refund of the total amount paid including any trade-in. All contracts and agreements should be promptly cancelled.

The buyer may return the hearing aid for a refund only if the:

*device is not specifically fit for the particular needs of the buyer, and
*buyer has not abused the device, and
*buyer has returned the device to the seller for adjustment or replacement within the 30 days, and
*seller has failed to adjust the device or replace it with a device that is specifically fit for the buyer's needs.

The hearing aid dispenser is not required by law to provide a refund if the:

*the device has been abused or damaged by the buyer;
*the buyer keeps the device for more than 30 days from the date of delivery without seeking an adjustment;
*the buyer does not allow the dispenser an opportunity to adjust, repair or replace the device;
*the buyer feels he/she paid too much and returns the hearing aid; or
*the hearing aid is returned after the death of the buyer.
