On January 4, 2011, Mr. Dewey Hiltner of Home Rescue LLC provded BBB with the following statements:
In recent months, financial reversals beyond our control along with industry related problems, have made it impossible for Home Rescue, LLC to continue operations and has forced us to close our doors. Home Rescue has not taken on any new applications since April 2010 and is devoid of all assets.
Home Rescue, LLC heretofore submitted to the lender or servicer on our customer's behalf, sufficient documentation tailored to their particular lender/servicer's requirements to secure approval of a workout option. Most of the work has been completed. The Lenders will require updated information. Home Rescue wants to provide the following TIPS and recourses in hopes to provide further assistance.
In order to ensure that your loan modification proposal has the best possible chance for approval, YOU WILL NEED TO DO THE FOLLOWING:
1. Contact your lender or servicer at least once a week to ask about the status of your loan modification. Keep good NOTES on each phone call to refer back to if necessary.
2. The lender or servicer may and probably will ask you for updated income and expense information. You need to promptly provide that directly to the lender/servicer yourselves. Then follow up with a phone call to the lender to verify they received it and that nothing else is needed at that time.
3. If and when the application for modification is approved, you will need to execute an acceptance document that puts the new terms in place.
4. There may be a required "trial" period during which you will be required to make timely payments based upon the new modified loan terms. It is critical that you make these payments on time and in the required amount. Once you successfully complete the trial period, contact your lender to make the loan modification permanent.

In April 2010, BBB notified Home Rescue LLC concerning an increase in the number of consumer complaints, as well as a pattern of complaints alleging the company was not adequately responsive to requests for assistance, that refunds were not being issued promptly and that the company was not making sufficient efforts to obtain loan modifications. The company responded promptly to BBB and addressed all issues. They informed BBB that they had completed over 2,000 loan modifications and had refunded over $260,000. They stated many clients' situations are desperate and their expectations are for immediate response, but that clients are informed it may take upwards of 180 days to obtain an outcome. The company stated that the refunds were issued "as soon as possible" after it became clear that a loan modification would not be approved or would not be secured. The company's statistics showed they had received complaints on less than 1% of the accounts on which it contracted.
The company also stated that lenders send any documents to their customers, not to Home Rescue and Home Rescue was aware of situations where lenders misinformed or misled Home Rescue clients regarding receipt of any contact from Home Rescue.
The company stated they were also aware of situations where lenders referred clients to BBB to file complaints because they confused Home Rescue LLC with other companies with similar names in FL, CA and AZ which were determined to be fraudulent.
Finally, due to the issues stated above and the state of the loan modification industry at this time, Home Rescue LLC notified BBB on May 28, 2010 that the company stopped accepting any new applications for loan modifications "for the time being."
